An action against the Kingdom of Sweden was brought before the Court of Justice of the European Communities on 22 September 2004 by the Commission of the European Communities, represented by K. Simonsson and W. Wils, acting as Agents, with an address for service in Luxembourg.
The applicant claims that the Court should:

Declare that Sweden has failed to fulfil its obligations under Directive 2001/16/EC (1) of the European Parliament and of the Council of 19 March 2001 on the interoperability of the trans-European conventional rail system by failing to adopt the laws and other provisions necessary to comply with the directive or, in any event, by failing to inform the Commission thereof, and |

2. |
Order Sweden to pay the costs. |
Pleas in law and main arguments:
The period prescribed for the implementation of the directive ended on 20 April 2003.
