The Court:

1.

Annuls Commission Decision C(2012) 5718 final of 6 August 2012 rejecting a request for confidential treatment submitted by Pilkington Group Ltd under Article 8 of Decision 2011/695/EU of the President of the European Commission of 13 October 2011 on the function and terms of reference of the hearing officer in certain competition proceedings (Case COMP/39.125 — Car glass), in so far as it relates to the request by Pilkington Group concerning recital 115 of Decision C(2008) 6815 final of 12 November 2008 relating to a proceeding under Article 81 [EC] and Article 53 of the EEA Agreement;

2.

Dismisses the action as to the remainder;

3.

Orders Pilkington Group to pay the costs.
