Summary

Notwithstanding the question whether a decision ordering the recovery of State aid under the ECSC Treaty should be notified to the undertaking concerned, that undertaking cannot escape its action being time-barred by relying on the fact that the decision was not notified to it if it was aware of the existence of that decision and did not ask within a reasonable time for the decision to be sent to it.
