EXPLANATORY MEMORANDUM

The Commission hereby informs the European Parliament, the Council, the European Economic and Social Committee and the Committee of the Regions that it is withdrawing its proposal of 8 March 2024, entitled:

Proposal for a Regulation of the European Parliament and of the Council amending Regulation (EU) 2021/522, Regulation (EU) 2021/1057, Regulation (EU) 2021/1060, Regulation (EU) 2021/1139, Regulation (EU) 2021/1229 and Regulation (EU) 2021/1755 as regards changes to the amounts of funds for certain programmes and funds.

This proposal was included in Annex IV (Withdrawals) of the Commission Work Programme 2025 (COM(2025) 45 final), where the Commission indicated its intention to withdraw the proposal on the grounds that no foreseeable agreement could be reached between the co-legislators.

The co-legislators did not reach an agreement on the Omnibus package due to the diverging interpretation of the Interinstitutional Agreement of 16 December 2020 between the European Parliament, the Council of the European Union and the European Commission on budgetary discipline, on cooperation in budgetary matters and on sound financial management, as well as on new own resources, including a roadmap towards the introduction of new own resources (OJ L 433I, 22.12.2020, p. 28). As a result, the proposal remains formally pending, although it is no longer politically viable.

The original Omnibus proposal also included a Brexit Adjustment Reserve (BAR) related amendment, intended to introduce the legal basis for redistributing the outstanding BAR amounts among Member States. The BAR-related amendment was not as such considered problematic from the point of view of the Interinstitutional Agreement. Since the Omnibus has not advanced and is now being withdrawn, the BAR amendment contained within it can no longer be adopted through that package.

In parallel, the Commission has therefore presented a new, targeted amendment to Regulation (EU) 2021/1755 of the European Parliament and of the Council 1 , providing the legal basis for the redistribution 2 . The content of the amendment is substantively identical to the provisions concerning the Brexit Adjustment Reserve included in the Omnibus proposal. Differences are limited to structure, labelling and numbering, recitals, and a revised explanatory memorandum. Consequently, the new amendment proposal replaces and supersedes the earlier proposal.

In order to ensure legal clarity and coherence of the legislative framework, the Commission therefore proceeds with the formal withdrawal of the proposal.
