This staff working document provides details of the committees that assist the Commission in each policy sector and a snapshot of their activities in 2023. It lists all the committees each of Commission departments are responsible for, in order to provide transparency with regard to policy sector activities. The comments below the tables highlight important changes (e.g. the creation, transfer or abolition of committees or procedures), together with cases referred to the appeal committee and, for the regulatory procedure with scrutiny, cases referred to the Council (in cases where the committee issued a negative opinion or no opinion) or in which the European Parliament or the Council opposed the adoption of a measure during the year in question.

Explanatory remarks
The following explanations are intended to help the reader better understand the work of comitology committees and the statistical data presented.
Opinions delivered by the committees may concern various types of draft Commission acts (directives, regulations, decisions).
The impact of the committee’s opinion varies, depending on the procedure.
Under the examination procedure, following a positive opinion the Commission shall adopt the implementing act. Following a negative opinion, the Commission cannot adopt the implementing act. In case the committee delivers a no opinion ((i.e. after the committee has taken a vote, there is no qualified majority either in favour or against the draft act), the Commission may adopt the implementing act, except in the following three cases where a
no opinion has a blocking effect according to Art. 5 (4), 2nd subparagraph of Regulation 182/2011 (the Comitology Regulation):
·where the draft implementing act concerns certain areas referred to in Art. 5 (4), 2nd subparagraph point a);
·where the basic legal act provides that the draft implementing act may not be adopted where no opinion is delivered;
·or where a simple majority of the members of the committee opposes the draft.
In cases of a negative opinion or ‘no opinion’ with a blocking effect, if the Commission deems the act necessary, it can continue the procedure, either by amending the draft implementing act and submitting the revised version to the (same) committee or by referring the original draft to the appeal committee. In the latter case, if the appeal committee delivers a positive opinion, the Commission shall adopt the implementing act and it may also adopt the implementing act if the appeal committee gives no opinion. If the appeal committee delivers a negative opinion, the Commission cannot adopt the implementing act.
Under the advisory procedure, the committee’s opinion is not legally binding, but the Commission must take utmost account of the conclusions drawn from the discussions within the committee and of the opinion delivered before deciding on the draft implementing act.
Under the regulatory procedure with scrutiny, following a positive opinion, the European Parliament and the Council may oppose the adoption of a draft measure, even if the committee has given a positive opinion. If, by the end of the scrutiny period, neither the European Parliament nor the Council has opposed the draft measure, the Commission shall adopt the measure. If a negative opinion or no opinion is given, the Commission submits a proposal relating to the measure to the Council, which then has the power to decide (see Cases referred to the Council).
The total number of positive opinions delivered by committees may differ from the number of implementing acts/measures adopted by the Commission in a given sector, if opinions are delivered one year but the instruments are not adopted until the following year.
As regards the list of committees, all those are listed that had a valid legal basis in 2023, during the entire year or part of it. In certain cases, the committee was abolished at some point of the year as the basic act establishing it was repealed; these cases are flagged as ‘abolished’ in the remarks following the summary tables.
The committees are listed per Commission service (Directorate-General/DG). To note that in certain cases, the committees are managed jointly by different DGs. Some committees therefore work on implementing acts that fall under the responsibility of various DGs and as a result, acts prepared in the same committee are eventually adopted by different DGs.
A number of committees had no activity at all in the reporting year. This is indicated by the figure ‘0’ in all columns.
In a limited number of cases, the changes made in the Comitology Register in 2023 (i.e. new committees set up or old ones abolished) reflected a change in the legal situation that had already occurred prior to 2023. Consequently, some committees were added 1 to or removed 2 from the tables below – compared to last year’s report – without being identified for 2023 as ‘newly created’ or ‘abolished’, since the report takes the legal and not the technical changes as reference point.
