EXPLANATORY MEMORANDUM

1. Council Decision 2011/[…]/CFSP of […] amends Common Position 2002/402/CFSP concerning restrictive measures directed against Usama bin Laden, members of the Al-Qaida organisation and the Taliban and other individuals, groups, undertakings and entities associated with them.

2. The objective of the amendment to the Common Position is to remove references to Usama bin Laden and to the Taliban. This follows the death of Usama bin Laden and the decision of the United Nations Security Council to separate Al Qaida and Taliban into two separate Resolutions UNSCR 1988 and UNSCR 1989.

3. Council Regulation (EC) No 881/2002 should therefore be amended accordingly.

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 215(2) thereof,

Having regard to Council Decision 2011/[…]/CFSP of […] amending Council Common Position 2002/402/CFSP concerning restrictive measures directed against Usama bin Laden, members of the Al-Qaida organisation and the Taliban and other individuals, groups, undertakings and entities associated with them,

Having regard to the joint proposal from the High Representative of the Union for Foreign Affairs and Security Policy and the Commission,

Whereas:

(1) On 27 May 2002, the Council adopted Common Position 2002/402/CFSP concerning restrictive measures against Usama bin Laden, members of the Al-Qaida organisation and the Taliban and other individuals, groups, undertakings and entities associated with them[1] and Council Regulation (EC) No 881/2002[2] imposing certain specific restrictive measures directed against certain persons and entities associated with Usama bin Laden, the Al-Qaida network and the Taliban, and repealing Council Regulation (EC) No 467/2001 prohibiting the export of certain goods and services to Afghanistan, strengthening the flight ban and extending the freeze of funds and other financial resources in respect of the Taliban of Afghanistan.

(2) On 17 June 2011, the United Nations Security Council (“Security Council”), acting under Chapter VII of the Charter of the United Nations, adopted Resolution 1989 (2011) concering threats to international peace and security caused by terrorist acts.

(3) On […] 2011, the Council of the European Union adopted Council Decision 2011/[…]/CFSP amending Council Common Position 2002/402/CFSP concerning restrictive measures directed against Usama bin Laden, members of the Al-Qaida organisation and the Taliban and other individuals, groups, undertakings and entities associated with them.

(4) Council Regulation (EC) No 881/2002 should therefore be amended accordingly,

HAS ADOPTED THIS REGULATION:

Article 1

Council Regulation (EC) No 881/2002 is amended as follows:

1.           In the first part of the title of Council Regulation (EC) No 881/2002 the references to "Usama bin Laden" and "and the Taliban" will be deleted so as to read as follows:

‘Council Regulation (EC) No 881/2002 of 27 May 2002 imposing certain specific restrictive measures directed against certain persons and entities associated with the Al-Qaida network, and repealing Council Regulation (EC) No 467/2001 prohibiting the export of certain goods and services to Afghanistan, strengthening the flight ban and extending the freeze of funds and other financial resources in respect of the Taliban of Afghanistan’.

2.           In article 1 paragraph 5, the words "and the Taliban" are deleted.

3.           In article 2 paragraph 3, the words "Usama bin Laden" and "and the Taliban" are deleted.

Article 2

Annex I to Regulation (EC) No 881/2002 is amended in accordance with the Annex to this Regulation.

Article 3

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
