Notice concerning the anti-dumping measures in force in respect of imports into the Community of certain iron or steel ropes and cables originating, inter alia, in Russia: change of the name of a company from which an undertaking was accepted

Imports of certain iron or steel ropes and cables (‘SWR’) originating, inter alia, in Russia are subject to a definitive anti-dumping duty imposed by Council Regulation (EC) No 1601/2001 (1).

An undertaking was accepted by Commission Decision 2001/602/EC (2) from Open Joint Stock Company Cherepovetsky Staleprokatny Zavod (‘ChSPZ’). ChSPZ has informed the Commission that on 1 January 2006, as a result of a merger with Open Joint Stock Company Orlovsky Staleprokatny Zavod (‘OSPAZ’) and Closed Joint Stock Company Severstal-Metiz, it changed its name into Closed Joint Stock Company Severstal-Metiz (‘SSM’).

The company has argued that the change of name does not affect the right of the merged company to benefit from the undertaking given by the company under its previous name of ChSPZ.

The name change applies as of 1 January 2006, i.e. the date when ChSPZ and OSPAZ ceased to exist as legal entities. The address of the merged company is the same as that of ChSPZ. It should be noted that a review under Article 11(3) of Council Regulation (EC) No 384/96 (3) is currently ongoing (4). Since the publication of the result of that review is still pending, it was considered necessary to clarify already at this time in a notice that the merged company SSM is entitled to benefit from the terms of the undertaking.

The Commission has examined the information supplied and concluded that the change of name in no way affects the findings of Council Regulation (EC) No 1601/2001, as amended. Therefore, the reference to Open Joint Stock Company Cherepovetsky Staleprokatny Zavod should be read as Closed Joint Stock Company Severstal-Metiz in Articles 1 and 2 of Council Regulation (EC) No 1601/2001 and in Article 1 of Commission Decision 2001/602/EC.

The Taric additional code A217 previously attributed to Open Joint Stock Company Cherepovetsky Staleprokatny Zavod shall apply to Closed Joint Stock Company Severstal-Metiz.
