Proposal for a Council Regulation establishing a system of compensation for the additional costs incurred in the marketing of certain fishery products from the Azores, Madeira, the Canary Islands and the French department of Guiana as a result of their very remote location (COM(94)0473 - C4-0235/94 - 94/0255(CNS))

The proposal was appproved with the following amendments:

Having regard to the need to rationalize the fishing effort with a view to ensuring sound management of stocks, and taking particular account of the study carried out to this end to a high technical standard by various scientific institutions in the outermost regions, such as the Department of Oceanography and Fisheries of the University of the Azores;

Whereas, in view of the exceptional nature of the measures decided on, it is necessary to inform the budgetary authority of the implementation of this Regulation;

Article 2(1)

1. For the Azores and Madeira, the system referred to in Article 1 shall consist of the payment of ECU 155 per tonne up to a maximum of 15 000 tonnes of tuna per year delivered to local industry (10 000 tonnes for the Azores and 5 000 tonnes for Madeira).

For the Azores and Madeira, the system referred to in Article 1 shall consist of the payment of ECU 155 per tonne up to a maximum of 13 000 tonnes per year of tuna caught by vessels registered in the ports of the Azores or Madeira and delivered to local industry (8 000 tonnes for the Azores and 5 000 tonnes for Madeira) and, for small-scale and coastal fishing in the Azores, ECU 155 per tonne for small pelagic species for marketing, processing or freezing such as black-mouth dogfish, silver scabbardfish, alfonsino, conger eel, hake, horse mackerel and chub mackerel, up to a maximum of 2 000 tonnes per year.

1a. If the total annual quota pursuant to paragraph 1 is not used up by the catches of vessels registered in ports of the Azores and/or Madeira, the parties concerned may use tuna from other Member States.

2. For the Canary Islands, the system referred to in Article 1 shall consist of the payment of ECU 125 per tonne, up to a maximum of 10 400 tonnes per year, of tuna for marketing fresh, ECU 45 per tonne, up to a maximum of 3 500 tonnes per year of frozen tuna, ECU 85 per tonne, up to a maximum of 10 500 tonnes per year, of sardines and mackerel for canning and ECU 45 per tonne, up to a maximum of 7 000 tonnes per year, of sardine and mackerel for freezing.

For the Canary Islands, the system referred to in Article 1 shall consist of the payment of ECU 125 per tonne, up to a maximum of 10 400 tonnes per year, of tuna marketed fresh, ECU 45 per tonne, up to a maximum of 3 500 tonnes per year, of frozen tuna, ECU 85 per tonne, up to a maximum of 10 500 tonnes per year, of sardines and mackerel for processing and ECU 45 per tonne, up to a maximum of 7 000 tonnes per year, of sardine and mackerel for freezing.

The measures provided for in this Regulation shall apply to the producers or producers' organizations of the regions referred to in Article 2.

Every three years, commencing on 1 January 1998, the Commission shall present the European Parliament and the Council with a report on the implementation of the measures provided for in this Regulation accompanied, where appropriate, by proposals for any adjustments which might be necessary to achieve the objectives set out in Article 1.

Every three years, commencing on 1 January 1998, the Commission shall present the European Parliament, the Council, the Economic and Social Committee and the Committee of the Regions with a report on the implementation of the measures provided for in this Regulation accompanied, where appropriate, by proposals for any adjustments which might be necessary to achieve the objectives set out in Article 1.

Article 5a (new)

The Commission shall submit to the European Parliament and the Council by 1 May each year a statement of payments effected pursuant to this Regulation including a detailed list of beneficiaries.

The European Parliament,

- having regard to the Commission proposal to the Council, COM(94)0473 - 94/0255 (CNS) ((OJ C 343, 6.12.1994, p. 17.)),

- having been consulted by the Council pursuant to Article 43 of the EC Treaty (C4-0235/94),

- having regard to Rule 58 of its Rules of Procedure.

- having regard to the report of the Committee on Fisheries and the opinion of the Committee on Budgets (A4-0053/95),

1. Approves the Commission proposal, subject to Parliament's amendments;

2. Calls on the Council to notify Parliament should it intend to depart from the text approved by Parliament;

3. Asks to be consulted again should the Council intend to make substantial modifications to the Commission proposal;

4. Instructs its President to forward this opinion to the Council and Commission.
