COMMISSION IMPLEMENTING REGULATION (EU) 2024/1885

cancelling the Union authorisation for the biocidal product family ‘Lyso IPA Surface Disinfection’ in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council and repealing Commission Implementing Regulation (EU) 2021/978

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 528/2012 of the European Parliament and of the Council of 22 May 2012 concerning the making available on the market and use of biocidal products (1), and in particular Article 49 thereof,

Whereas:

On 10 June 2021, Commission Implementing Regulation (EU) 2021/978 (2) granted a Union authorisation with the authorisation number EU-0023860-0000 to the authorisation holder Schülke & Mayr GmbH for the making available on the market and use of the same biocidal product family ‘Lyso IPA Surface Disinfection’ in accordance with Article 44 (5) of Regulation (EU) No 528/2012.

On 23 January 2024 Schülke & Mayr GmbH submitted a request to cancel this Union authorisation to the European Chemicals Agency (‘the Agency’) in accordance with Article 49 of Regulation (EU) No 528/2012. The request was recorded under case number BC-GQ091762-19 in the Register for Biocidal Products.

(3)	On 12 February 2024, the Agency requested Schülke & Mayr GmbH to justify the request and on 13 February 2024, Schülke & Mayr GmbH provided that the request was made due to business reasons. The Agency forwarded the request to the Commission on the same day.

(4)	It is therefore appropriate to cancel the Union authorisation for the biocidal product family ‘Lyso IPA Surface Disinfection’ at the request of the authorisation holder and consequently to repeal Implementing Regulation (EU) 2021/978.

(5)	It is also appropriate to grant a period of grace for the making available on the market and the use of the existing stocks in accordance with Article 52 of Regulation (EU) No 528/2012,

HAS ADOPTED THIS REGULATION:

Article 1

The Union authorisation for the biocidal product family ‘Lyso IPA Surface Disinfection’ granted by Implementing Regulation (EU) 2021/978 to Schülke & Mayr GmbH with the authorisation number EU-0023860-0000 is cancelled.

Article 2

Implementing Regulation (EU) 2021/978 is repealed.

Article 3

Biocidal products of biocidal product family ‘Lyso IPA Surface Disinfection’ shall no longer be made available on the market from 26 January 2025 and existing stocks of such biocidal products shall no longer be used from 25 July 2025.

Article 4

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
