COMMISSION IMPLEMENTING REGULATION (EU) 2023/953

of 12 May 2023

amending Implementing Regulation (EU) 2020/761 as regards the rules governing the tariff rate quota for export of milk powder to the Dominican Republic

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007 (1), and in particular Article 187 thereof,

Whereas:

Commission Implementing Regulation (EU) 2020/761 (2) lays down the rules for the management of import and export tariff quotas for agricultural products managed by a system of import and export licences and provides for specific rules for the administration of those quotas.

(2)

As of 1 July 2023, according to the Economic Partnership Agreement between the CARIFORUM States and the European Community and its Member States (3), the Dominican Republic may import milk powder from the Union at zero duty for an unlimited quantity. As a consequence and for the reason of clarity, the provisions on the tariff rate quota for exports of milk powder from the Union to the Dominican Republic should be removed from Implementing Regulation (EU) 2020/761 with the application as of the next licence application period.

Implementing Regulation (EU) 2020/761 should therefore be amended accordingly.

The measures provided for in this Regulation are in accordance with the opinion of the Committee for the Common Organisation of Agricultural Markets,

HAS ADOPTED THIS REGULATION:

Article 1

Implementing Regulation (EU) 2020/761 is amended as follows:

(1)

Articles 55, 56 and 57 are deleted;

(2)

Annex I and Annex XIII, Part B – Sector: Milk are amended in accordance with the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the seventh day following that of its publication in the Official Journal of the European Union.

It shall apply as of the first licence application period for the tariff quota period starting on 1 July 2023.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
