DECISION OF THE EEA JOINT COMMITTEE No 55/2024

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2024/1616]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (“the EEA Agreement”), and in particular Article 98 thereof,

Whereas:

(1)	Commission Implementing Regulation (EU) 2023/2782 of 14 December 2023 laying down the methods of sampling and analysis for the control of the levels of mycotoxins in food and repealing Regulation (EC) No 401/2006 (1) is to be incorporated into the EEA Agreement.

(2)	Commission Implementing Regulation (EU) 2023/2783 of 14 December 2023 laying down the methods of sampling and analysis for the control of the levels of plant toxins in food and repealing Regulation (EU) 2015/705 (2) is to be incorporated into the EEA Agreement.

(3)	Implementing Regulation (EU) 2023/2782 repeals Commission Regulation (EC) No 401/2006 (3), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(4)	Implementing Regulation (EU) 2023/2783 repeals Commission Regulation (EU) 2015/705 (4), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

This Decision concerns legislation regarding foodstuffs. Legislation regarding foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the introduction to Chapter XII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

(6)	Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter XII of Annex II to the EEA Agreement shall be amended as follows:

The text of point 54zzzl (Commission Regulation (EC) No 401/2006) is replaced by the following:

‘ 32023 R 2782: Commission Implementing Regulation (EU) 2023/2782 of 14 December 2023 laying down the methods of sampling and analysis for the control of the levels of mycotoxins in food and repealing Regulation (EC) No 401/2006 (OJ L, 2023/2782, 15.12.2023).’

The text of point 54zzzn (deleted) is replaced by the following:

‘ 32023 R 2783: Commission Implementing Regulation (EU) 2023/2783 of 14 December 2023 laying down the methods of sampling and analysis for the control of the levels of plant toxins in food and repealing Regulation (EU) 2015/705 (OJ L, 2023/2783, 15.12.2023).’

3.	The text of point 108 (Commission Regulation (EU) 2015/705) is deleted.

Article 2

The texts of Implementing Regulations (EU) 2023/2782 and (EU) 2023/2783 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 16 March 2024, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
