DECISION OF THE EEA JOINT COMMITTEE

No 102/2017

of 5 May 2017

amending Protocol 31 to the EEA Agreement, on cooperation in specific fields outside the four freedoms [2019/214]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Articles 86 and 98 thereof,

Whereas:

It is appropriate to extend the cooperation of the Contracting Parties to the EEA Agreement to include Decision No 1386/2013/EU of the European Parliament and of the Council of 20 November 2013 on a General Union Environment Action Programme to 2020 ‘Living well, within the limits of our planet’ (1).

(2)

Protocol 31 to the EEA Agreement should therefore be amended in order to allow for this extended cooperation to take place,

HAS ADOPTED THIS DECISION:

Article 1

The following point shall be added in Article 3(7) of Protocol 31 to the EEA Agreement:

‘(e)

32013 D 1386: Decision No 1386/2013/EU of the European Parliament and of the Council of 20 November 2013 on a General Union Environment Action Programme to 2020 ‘Living well, within the limits of our planet’ (OJ L 354, 28.12.2013, p. 171).’

Article 2

This Decision shall enter into force on the day following the last notification under Article 103(1) of the EEA Agreement (*1).

Article 3

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

Declaration by the EFTA States to Decision of the EEA Joint Committee No 102/2017 including Decision No 1386/2013/EU of the European Parliament and of the Council into Protocol 31 of the EEA Agreement

The General Union Environment Action Programme to 2020 ‘Living well, within the limits of our planet’ includes elements that fall outside the scope of the EEA Agreement. The EFTA States underline that the inclusion of the Programme in Protocol 31 of the Agreement is without prejudice to the scope of the EEA Agreement.
