DECISION OF THE EEA JOINT COMMITTEE

amending Annex XIII (Transport) to the EEA Agreement [2019/209]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)	Regulation (EU) 2016/2337 of the European Parliament and of the Council of 14 December 2016 repealing Regulation (EEC) No 1192/69 of the Council on common rules for the normalisation of the accounts of railway undertakings (1) is to be incorporated into the EEA Agreement.

(2)

Regulation (EU) 2016/2337 repeals Council Regulation (EEC) No 1192/69 (2), with the exception of the provisions that apply to the normalisation of accounts for Class IV cases covered by Annex IV to Regulation (EEC) No 1192/69, which continue to apply until 31 December 2017. Regulation (EEC) No 1192/69, which is incorporated into the EEA Agreement, is consequently to be repealed under the EEA Agreement with effect from 1 January 2018.

(3)	After 31 December 2017, Regulation (EU) 2016/2337 will become obsolete and is consequently to be repealed under the EEA Agreement with effect from 1 January 2018.

(4)	Annex XIII to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex XIII to the EEA Agreement shall be amended as follows:

(1)

The following point is inserted after point 39 (Council Regulation (EEC) No 1192/69):

‘39a.

32016 R 2337: Regulation (EU) 2016/2337 of the European Parliament and of the Council of 14 December 2016 repealing Regulation (EEC) No 1192/69 of the Council on common rules for the normalisation of the accounts of railway undertakings (OJ L 354, 23.12.2016, p. 20).’

(2)	In paragraph II of the SECTORAL ADAPTATIONS the words ‘Article 3 of Regulation (EEC) No 1192/69,’ shall be deleted with effect from 1 January 2018.

(3)	The text of points 39 (Council Regulation (EEC) No 1192/69) and 39a (Regulation (EU) 2016/2337 of the European Parliament and of the Council) shall be deleted with effect from 1 January 2018.

Article 2

The text of Regulation (EU) 2016/2337 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 6 May 2017, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
