DECISION OF THE EEA JOINT COMMITTEE

amending Annex XI (Electronic communication, audiovisual services and information society) to the EEA Agreement [2019/207]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Implementing Decision (EU) 2016/2295 of 16 December 2016 amending Decisions 2000/518/EC, 2002/2/EC, 2003/490/EC, 2003/821/EC, 2004/411/EC, 2008/393/EC, 2010/146/EU, 2010/625/EU, 2011/61/EU and Implementing Decisions 2012/484/EU, 2013/65/EU on the adequate protection of personal data by certain countries, pursuant to Article 25(6) of Directive 95/46/EC of the European Parliament and of the Council (1) is to be incorporated into the EEA Agreement.

(2)

Commission Implementing Decision (EU) 2016/2297 of 16 December 2016 amending Decisions 2001/497/EC and 2010/87/EU on standard contractual clauses for the transfer of personal data to third countries and to processors established in such countries, under Directive 95/46/EC of the European Parliament and of the Council (2) is to be incorporated into the EEA Agreement.

(3)	Commission Decision 2000/519/EU (3), which is incorporated into the EEA Agreement, has become obsolete and is consequently to be repealed under the EEA Agreement.

(4)	Annex XI to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex XI to the EEA Agreement shall be amended as follows:

The following is added in points 5ea (Commission Decision 2000/518/EC), 5ee (Commission Decision 2002/2/EC), 5eg (Commission Decision 2003/490/EC), 5eh (Commission Decision 2003/821/EC), 5ei (Commission Decision 2004/411/EC), 5ek (Commission Decision 2008/393/EC), 5el (Commission Decision 2010/146/EU), 5em (Commission Decision 2010/625/EU), 5en (Commission Decision 2011/61/EU), 5eo (Commission Implementing Decision 2012/484/EU) and 5ep (Commission Implementing Decision 2013/65/EU):

‘, as amended by:

—	32016 D 2295: Commission Implementing Decision (EU) 2016/2295 of 16 December 2016 (OJ L 344, 17.12.2016, p. 83).’

The following indent is added in point 5ed (Commission Decision 2001/497/EU):

(3)

The following is added in point 5ef (Commission Decision 2010/87/EU):

‘, as amended by:

(4)	The text of point 5eb (Commission Decision 2000/519/EC) is deleted.

Article 2

The texts of Implementing Decisions (EU) 2016/2295 and (EU) 2016/2297 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 6 May 2017, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
