DECISION OF THE EEA JOINT COMMITTEE
No 187/2016

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2018/445]
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,
Whereas:

(1) |
Directive 2014/28/EU of the European Parliament and of the Council of 26 February 2014 on the harmonisation of the laws of the Member States relating to the making available on the market and supervision of explosives for civil uses (recast) (1) is to be incorporated into the EEA Agreement. |

(2) |
Directive 2014/28/EU repeals Commission Directives 93/15/EEC (2) and 2004/57/EC (3) which are incorporated into the EEA Agreement and which are consequently to be repealed under the EEA Agreement. |

(3) |
Annex II to the EEA Agreement should therefore be amended accordingly, |
HAS ADOPTED THIS DECISION:
Article 1
Chapter XXIX of Annex II to the EEA Agreement shall be amended as follows:

The text of point 1 (Council Directive 93/15/EEC) is replaced by the following: ‘ 32014 L 0028: Directive 2014/28/EU of the European Parliament and of the Council of 26 February 2014 on the harmonisation of the laws of the Member States relating to the making available on the market and supervision of explosives for civil uses (recast) (OJ L 96, 29.3.2014, p. 1).’ |

2. |
The text of point 3 (Commission Directive 2004/57/EC) is deleted. |
Article 2
The text of Directive 2014/28/EU in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.
Article 3
This Decision shall enter into force on 24 September 2016, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).
Article 4
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
