DECISION OF THE EEA JOINT COMMITTEE

No 23/2016

of 5 February 2016

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2017/1306]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Directive 2013/29/EU of the European Parliament and of the Council of 12 June 2013 on the harmonisation of the laws of the Member States relating to the making available on the market of pyrotechnic articles (1) is to be incorporated into the EEA Agreement.

(2)

Directive 2013/29/EU repeals Directive 2007/23/EC of the European Parliament and of the Council (2) which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA.

(3)

Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The text of point 4 (Directive 2007/23/EC of the European Parliament and of the Council) of Chapter XXIX of Annex II to the EEA Agreement is replaced by the following:

32013 L 0029: Directive 2013/29/EU of the European Parliament and of the Council of 12 June 2013 on the harmonisation of the laws of the Member States relating to the making available on the market of pyrotechnic articles (OJ L 178, 28.6.2013, p. 27).’

Article 2

The text of Directive 2013/29/EU in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 6 February 2016, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
