DECISION OF THE EEA JOINT COMMITTEE

No 2/2015

of 25 February 2015

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2016/490]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Implementing Regulation (EU) No 846/2014 of 4 August 2014 amending Annex D to Council Directive 92/65/EEC as regards the conditions for donor animals of the equine species (1) is to be incorporated into the EEA Agreement.

(2)

Commission Implementing Decision 2014/514/EU of 31 July 2014 authorising laboratories in the Republic of Korea to carry out serological tests to monitor the effectiveness of rabies vaccines (2) is to be incorporated into the EEA Agreement.

(3)

This Decision concerns legislation regarding live animals other than fish and aquaculture animals and animal products such as ova, embryo and semen. Legislation concerning these matters shall not apply to Iceland, as specified in paragraph 2 of the Introductory Part of Chapter I of Annex I to the EEA Agreement. This Decision is therefore not to apply to Iceland.

This Decision concerns legislation regarding veterinary matters. Legislation regarding veterinary matters shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter I of Annex I to the EEA Agreement shall be amended as follows:

(1)

the following indent is added in point 9 (Council Directive 92/65/EEC) in Part 4.1 and point 15 (Council Directive 92/65/EEC) in Part 8.1:

‘—

32014 R 0846: Commission Implementing Regulation (EU) No 846/2014 of 4 August 2014 (OJ L 232, 5.8.2014, p. 5).’;

(2)

the following point is inserted after point 98 (Commission Implementing Decision 2013/261/EU) in Part 4.2:

‘99.

32014 D 0514: Commission Implementing Decision 2014/514/EU of 31 July 2014 authorising laboratories in the Republic of Korea to carry out serological tests to monitor the effectiveness of rabies vaccines (OJ L 231, 2.8.2014, p. 11).

This act shall not apply to Iceland.’.

Article 2

The texts of Implementing Regulation (EU) No 846/2014 and Implementing Decision 2014/514/EU in the Norwegian language, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 26 February 2015, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
