DECISION OF THE EEA JOINT COMMITTEE

amending Protocol 47 (on the abolition of technical barriers to trade in wine) to the EEA Agreement
THE EEA JOINT COMMITTEE,
Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,
Whereas:

Commission Implementing Regulation (EU) No 670/2011 of 12 July 2011 amending Regulation (EC) No 607/2009 laying down certain detailed rules for the implementation of Council Regulation (EC) No 479/2008 as regards protected designations of origin and geographical indications, traditional terms, labelling and presentation of certain wine sector products (1) is to be incorporated into the EEA Agreement. |
(2) |
Commission Regulation (EC) No 1793/2003 (2), which is incorporated into the Agreement, has expired and shall consequently be repealed under the EEA Agreement. |
(3) |
This Decision concerns legislation regarding wine. Legislation regarding wine shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the seventh paragraph of the introduction to Protocol 47 to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein, |
HAS ADOPTED THIS DECISION:
Article 1
Protocol 47 to the EEA Agreement shall be amended as follows:

the text of point 7 (Commission Regulation (EC) No 1793/2003) shall be deleted; |
(2) |
the following shall be added in point 11 (Commission Regulation (EC) No 607/2009):
The provisions of the Regulation shall, for the purposes of this Agreement, be read with the following adaptation: The following shall be added in Article 70a: “The EFTA States shall, when concerned, follow the procedures set out in Article 70a(1)(b), 70a(2) and 70a(4).” ’. |
Article 2
The text of Implementing Regulation (EU) No 670/2011 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.
Article 3
This Decision shall enter into force on 1 November 2012, provided that all the notifications under Article 103(1) of the EEA Agreement have been made to the EEA Joint Committee (*1) or on the day of the entry into force of Decision of the EEA Joint Committee No 102/2012 of 30 April 2012 (3), whichever is the later.
Article 4
This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
