amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision No 124/2002 of the EEA Joint Committee of 27 September 2002(1).

(2) Directive 2001/85/EC of the European Parliament and of the Council of 20 November 2001 relating to special provisions for vehicles used for the carriage of passengers comprising more than eight seats in addition to the driver's seat, and amending Directives 70/156/EEC and 97/27/EC(2) is to incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter I of Annex II to the Agreement shall be amended as follows:

1. the following indent shall be added in point 1 (Council Directive 70/156/EEC):

"- 32001 L 0085: Directive 2001/85/EC of the European Parliament and of the Council of 20 November 2001 (OJ L 42, 13.2.2002, p. 1).";

2. the following shall be added in point 45w (Directive 97/27/EC of the European Parliament and of the Council):

", as amended by:

- 32001 L 0085: Directive 2001/85/EC of the European Parliament and of the Council of 20 November 2001 (OJ L 42, 13.2.2002, p. 1)."

3. the following point shall be inserted after point 45x (Directive 97/24/EC of the European Parliament and of the Council):

"45y. 32001 L 0085: Directive 2001/85/EC of the European Parliament and of the Council of 20 November 2001 relating to special provisions for vehicles used for the carriage of passengers comprising more than eight seats in addition to the driver's seat, and amending Directives 70/156/EEC and 97/27/EC (OJ L 42, 13.2.2002, p. 1).

The provisions of the Directive shall, for the purposes of the present Agreement, be read with the following adaptation:

(a) In Annex I, the following shall be added to paragraph 7.6.11.1:

'Neyðarútgangur'

'Nødutgang';

(b) In Annex I, the following shall be added to paragraph 7.7.9.1:

'Stoppistöð'

'Stopper'".

Article 2

The text of Directive 2001/85/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 3

This Decision shall enter into force on 9 November 2002, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(3).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.
