amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as adjusted by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as "the Agreement", and in particular Article 98 thereof,

Whereas:

(1) Annex II to the Agreement was amended by Decision No 19/2000 of the EEA Joint Committee of 25 February 2000(1).

(2) Commission Directive 1999/77/EC of 26 July 1999 adapting to technical progress for the sixth time Annex I to Council Directive 76/769/EEC on the approximation of the laws, regulations and administrative provisions of the Member States relating to restrictions on the marketing and use of certain dangerous substances and preparations (asbestos)(2) is to be incorporated into the Agreement.

(3) Commission Regulation (EC) No 2161/1999 of 12 October 1999 imposing further testing requirements on the importers or manufacturers of a certain priority substance as foreseen under Council Regulation (EEC) No 793/93 on the evaluation and control of the risks of existing substances(3) is to be incorporated into the Agreement.

(4) Commission Recommendation 1999/721/EC of 12 October 1999 on the results of the risk evaluation and on the risk reduction strategies for the substances: 2-(2-butoxyethoxy)ethanol; 2-(2-methoxyethoxy)ethanol; Alkanes, C10-13, chloro; Benzene, C10-13-alkyl derivs(4) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

The following indent shall be added in point 4 (Council Directive 76/769/EEC) in Chapter XV of Annex II to the Agreement:

"- 399 L 0077: Commission Directive 1999/77/EC of 26 July 1999 (OJ L 207, 6.8.1999, p. 18)."

Article 2

The following point shall be inserted after point 12h (Council Regulation (EC) No 142/97) in Chapter XV of Annex II to the Agreement:

"12i. 399 R 2161: Commission Regulation (EC) No 2161/1999 of 12 October 1999 imposing further testing requirements on the importers or manufacturers of a certain priority substance as foreseen under Council Regulation (EEC) No 793/93 on the evaluation and control of the risks of existing substances (OJ L 265, 13.10.1999, p. 11)."

Article 3

The following point shall be inserted after point 18 (Commission Communication C/130/93/p.2) in Chapter XV of Annex II to the Agreement:

"19. 399 X 0721: Commission Recommendation 1999/721/EC of 12 October 1999 on the results of the risk evaluation and on the risk reduction strategies for the substances: 2-(2-butoxyethoxy)ethanol; 2-(2-methoxyethoxy)ethanol; Alkanes, C10-13, chloro; Benzene, C10-13-alkyl derivs (OJ L 292, 13.11.1999, p. 42)."

Article 4

The texts of Directive 1999/77/EC, Regulation (EC) No 2161/1999 and Recommendation 1999/721/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Communities, shall be authentic.

Article 5

This Decision shall enter into force on 3 October 2000, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee(5).

Article 6

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Communities.
