Architects and entrepreneurs

Article 8, § 2(2), (3) and (4)

Where nationals of Member States move, under the freedom to provide services, to Belgium for the first time to exercise the profession of architect on a temporary and occasional basis, they must inform the Association of Architects in advance by written declaration containing information on insurance cover or other means of personal or collective protection in respect of professional liability, and including in particular a professional indemnity insurance certificate, including ten-year liability. That certificate may be issued by an insurance provider in another Member State if it states that the insurer has complied with the laws and regulations in Belgium as regards the detailed rules and scope of cover. Those nationals shall be registered by the Association of Architects in the register of service providers. The declaration shall be renewed annually if the service provider intends to provide temporary or occasional services in Belgium during the year in question. The service provider may give the declaration by any means.

At the time of the first provision of services or if there is a material change, that declaration must be accompanied by:

a certificate attesting that the holder has one of the diplomas, certificates or other evidence of formal qualifications referred to in Article 1 §§ 2 to 2/3 of the Law of 20 February 1939 on the protection of the title and profession of architect.

 

2.

Hunting

Article 4(1)

The insurer, its legal representative or its contact point in Belgium shall issue the insured person with an insurance certificate indicating the dates when the cover takes effect and expires and certifying that it is granted under the conditions laid down in this Decree.

 

3.

Hunting

Article 20

The insurer, its legal representative or its contact point in Belgium shall issue the insured person with an insurance certificate indicating the dates when the cover takes effect and expires and certifying that it is granted under the conditions laid down in this Decree.

 

4.

Environment

Article 7(2)

A certificate attesting that insurance or other financial security is in force in accordance with the provisions of this Convention shall be issued to each ship after the appropriate authority of a State Party has determined that the requirements of paragraph 1 have been complied with. With respect to a ship registered in a State Party such certificate shall be issued or certified by the appropriate authority of the State of the ship's registry; with respect to a ship not registered in a State Party it may be issued or certified by the appropriate authority of any State Party. This certificate shall be in the form of the model set out in the annex to this Convention and shall contain the following particulars:

(a)

name of ship, distinctive number or letters and port of registry;

(b)

name and principal place of business of the registered owner;

(c)

IMO ship identification number;

(d)

type and duration of security;

(e)

name and principal place of business of insurer or other person giving security and, where appropriate, place of business where the insurance or security is established;

(f)

period of validity of the certificate which shall not be longer than the period of validity of the insurance or other security.

 

5.

Establishments open to the public

Article 7

When concluding an insurance contract, the insurance undertaking shall issue to the policyholder a certificate, a model of which is set out in the Annex.

A duplicate of the certificate shall be sent to the mayor of the municipality in which the establishment accessible to the public is located.

 

6.

Nuclear facility

Article 15

Any carrier of nuclear substances shall be in possession of a certificate issued by or on behalf of the insurer or the financial guarantor who has furnished the security attesting that the provisions of Article 8 are complied with. That certificate must meet the conditions laid down in Article [1 4 d(1)] of the Paris Convention.

The King shall determine the detailed rules for the implementation of this Article.

Article 4(c) of the Paris Convention

(c)

The operator liable in accordance with this Convention shall provide the carrier with a certificate issued by or on behalf of the insurer or other financial guarantor furnishing the security required pursuant to Article 10. However, a Contracting Party may exclude this obligation in relation to carriage which takes place wholly within its own territory. The certificate shall state the name and address of that operator and the amount, type and duration of the security, and these statements may not be disputed by the person by whom or on whose behalf the certificate was issued. The certificate shall also indicate the nuclear substances and the carriage in respect of which the security applies and shall include a statement by the competent public authority that the person named is an operator within the meaning of this Convention.

 

7.

Mediation

Article 3

In order to make a valid request for entry in the register of insurance and reinsurance intermediaries, the applicant, if a natural person, must attach the following documents to that application:

[…]

(4)

(a)

a certificate issued by the insurance undertaking or credit institution which, in accordance with Chapter VI of this Decree, granted a security or bank guarantee;

(b)

for insurance or reinsurance intermediaries which are exempt from the obligation of a security or bank guarantee, a document attesting that the insurance undertaking, the reinsurance undertaking, the insurance intermediary or the reinsurance intermediary for which they act undertakes to take action if the insurance and reinsurance intermediaries are in default;

(5)

(a)

a certificate issued by the insurance undertaking with which, in accordance with Chapter VII of this Decree, professional indemnity insurance has been taken out;

(b)

for insurance or reinsurance intermediaries who are exempt from taking out professional indemnity insurance, a certificate issued by insurance undertakings, reinsurance undertakings or other insurance or reinsurance intermediaries, including credit institutions, for whom or on behalf of whom they act, confirming that they assume liability for the insurance and reinsurance intermediaries.

 

8.

Mediation

Article 3 §2

The debt collector must submit, together with the request for registration, the number of the undertaking or the data which provides the information referred to in Article 2 § 1(1)(2) of the Decree if the debt collector is established in another Member State of the European Union, and a certificate from the insurance company with which the debt collector has taken out professional liability insurance, where it is expressly mentioned that the insurance contract satisfies the conditions set out in the Decree.

At the request of competent officials of the Directorate-General for Regulation and Organisation of the Market of the Federal Public Service Economy, SMEs, Self-Employed and Energy, the debt collector is required to provide them with a copy of the insurance contract and to adduce proof that the premium has been paid.

 

9.

Mediation

Article 3(4)

In order to make a valid request for entry in the register of banking and investment services intermediaries, the applicant, if a natural person, must attach the following documents to that application:

a certificate issued by the insurance company with which professional liability insurance has been taken out in accordance with the provisions of Chapter V, which shows that the insurance satisfies the conditions set out in Article 11; for banking and investment services intermediaries which are exempt, pursuant to Article 8(1)(5) of the Law, from the obligation to take out professional indemnity insurance, a certificate issued by the regulated undertaking or undertakings for which they act, and in which the undertaking or undertakings state(s) that they irrevocably and unconditionally assume the obligations of the intermediary as regards liability.

Article 4(11)

Without prejudice to the right of the FSMA to request the additional information it deems necessary to assess the file, in order to make a valid request for approval as a lender, the applicant shall include the following information in the request and attach the following documents:

(11)

an indication of whether or not the lender will exercise the activity of credit intermediary and, where appropriate, a certificate issued by the insurance undertaking with which professional indemnity insurance has been taken out in accordance with Article VII.180 § 2(1)(4) and/or Article VII.184 § 1(2)(4) of the Code on Economic Law, which shows that that insurance meets the conditions laid down in Chapter IV;

Article 7(10)

Without prejudice to the right of the FSMA to request the additional information it deems necessary to assess the file, in order to make a valid request for registration as a credit intermediary in the category of loan brokers, tied agents or sub-agents, the applicant, if a natural person, must include the following information in the request and attach the following documents:

subject to the provision in Article 11, a certificate issued by the insurance undertaking with which professional indemnity insurance has been taken out in accordance with Article VII.181 § 1(1)(3) and/or Article VII.186 § 1(1)(3) of the Code on Economic Law, which shows that that insurance meets the conditions laid down in Chapter IV;

Article 9(7)

Without prejudice to the right of the FSMA to request the additional information it deems necessary to assess the file, in order to make a valid request for registration as a consumer credit intermediary in the category of ancillary agents, the applicant shall include the following information in that request and attach the following documents:

12.

Safety and security

Article 3(3)

The request for authorisation from an undertaking having a place of business in Belgium shall contain the following documents and information:

a valid insurance certificate concerning the civil and contractual liability insurance of the maritime safety undertaking, as provided for by Article 3 of the Law, for which the model is laid down by the Royal Decree of 27 June 1991 laying down the arrangements for the civil liability insurance of security undertakings, internal security undertakings and maritime safety undertakings.

Safety and security

Article 2

If the policyholder is a security undertaking or a legal or natural person organising an internal security service or a security service, they shall send the administration, when concluding an insurance contract, an insurance certificate drawn up in accordance with the model in Annex 1.

If the policyholder is a maritime security undertaking, it shall send the administration, when concluding an insurance contract, an insurance certificate drawn up in accordance with the model in Annex 2.

 

14.

Waste heaps

A certificate attesting that insurance or other financial security is in force in accordance with the provisions of this Convention shall be issued to each ship of 300 gross tonnage and above by the appropriate authority of the State of the ship's registry after determining that the requirements of paragraph 1 have been complied with. With respect to a ship registered in a State Party, such certificate shall be issued or certified by the appropriate authority of the State of the ship's registry; with respect to a ship not registered in a State Party it may be issued or certified by the appropriate authority of any State Party. This compulsory insurance certificate shall be in the form of the model set out in the annex to this Convention, and shall contain the following particulars:

(a)

name of the ship, distinctive number or letters and port of registry;

(b)

gross tonnage of the ship;

(c)

name and principal place of business of the registered owner;

(d)

IMO ship identification number;

(e)

type and duration of security;

(f)

name and principal place of business of insurer or other person giving security and, where appropriate, place of business where the insurance or security is established; and

(g)

period of validity of the certificate, which shall not be longer than the period of validity of the insurance or other security.

 

16.

Transport

All vehicles must have on board at least the following documents:

Article 7

The existence of the insurance referred to in Article 5 shall be proved by one or more certificates issued by its provider and carried on board the ship.

The certificates issued by the insurance provider shall include the following information:

(1)

name of ship, its IMO number, and port of registry;

(2)

shipowner's name and principal place of business;

(3)

type and duration of the insurance;

(4)

name and principal place of business of the provider of the insurance and, where appropriate, the place of business where the insurance is established.

A certificate attesting that insurance or other financial security is in force in accordance with the provisions of this Convention shall be issued to each ship after the appropriate authority of a State Party has determined that the requirements of paragraph 1 have been complied with. With respect to a ship registered in a State Party, such certificate shall be issued or certified by the appropriate authority of the State of the ship's registry; with respect to a ship not registered in a State Party it may be issued or certified by the appropriate authority of any State Party. This certificate shall be in the form of the model set out in the annex to this Convention and shall contain the following particulars:

(a)

name of the ship, distinctive number or letters and port of registry;

(b)

name and principal place of business of the carrier who actually performs the whole or a part of the carriage;

(c)

IMO ship identification number;

(d)

type and duration of security;

(e)

name and principal place of business of insurer or other person providing financial security and, where appropriate, place of business where the insurance or other financial security is established; and

(f)

period of validity of the certificate, which shall not be longer than the period of validity of the insurance or other financial security.

The financial capacity referred to in Article 17 § 2 of the Law shall be proved by means of a certificate from one or more of the following bodies, showing that the body concerned gave the undertaking a joint and several guarantee:

Article 4

The insurance certificate referred to in Article 7 § 1 of the aforementioned Law of 21 November 1989 must state that a guarantee is given at least for events occurring on the territory:

(1)

of all States referred to in Article 3(1) of the Royal Decree of 13 February 1991 on the entry into force and implementation of the Law of 21 November 1989 on compulsory insurance against civil liability in respect of the use of motor vehicles, and:

(2)

of Morocco;

(3)

of Tunisia; and

BULGARIA

1.

Compulsory Accident insurance for passengers in public transport vehicles

Content of the insurance certificate:

the insurer business name;

the insurer's registered office and address of the place of management, insurers from third countries operating through a branch in the Republic of Bulgaria also indicating the registered office and address of the place of management of the insurer in the third country and of the branch in the Republic of Bulgaria;

the number of the act of the competent authority whereby a license has been issued for practicing insurance activity, insurers from third countries operating through a branch in the Republic of Bulgaria quoting the number of the act of the competent authority by registered office of the insurer in the third country and of the competent authority in the Republic of Bulgaria;

Unified Identification Code (UIC) for insurers with registered office in the Republic of Bulgaria, respectively registration number in the commercial or other similar register of insurers with registered office in a Member State or a third country;

the name and address, respectively business name, registered office, address of the place of management and the UIC of the passenger transport company with public transport means;

the name and address, respectively business name, registered office, address of the place of management and the UIC of the policyholder;

a serial number of the policy;

subject of the insurance contract;

covered insurance risks;

term of the contract, including the commencement and the termination date of the insured period and the period of the insured coverage;

insurance amount or the method of its determination;

the insurance premium or the method of its determination and the terms and conditions for its payment;

the names and address of the insurance intermediary, if the contract is concluded through an intermediary, and in case of insurance agents – also the number of their identification document;

the date and place of conclusion of the contract;

the signatures of the parties;

term of insurance validity (Article 35 of the Ordinance 49).

 

2.

Compulsory third party liability insurance of the tour operator

4.

Compulsory ship insurance of a chartered vessel

the voyage and the intermediate ports at which the vessel will call before the port of destination;

(6)

place and date of issue of the policy;

(7)

the insurance taker;

(8)

designation of the insurer and signature of the representative thereof.

Obligatory insurance against maritime perils of the vessel mortgagor

§ 2, cf. § 5 of the Executive Order no. 481 of 03/05/2018 on insurance brokers, reinsurance brokers and accessory insurance provider's liability insurance, warranty and treatment of trusted funds.

The broker must submit a declaration from the insurance company or bank with information on the requested indemnity insurance. The declaration form is prepared by the DFSA. By submitting this declaration, the insurance company guarantees that the indemnity insurance complies with the rules in § 2.

The declaration must according to § 2 i.a. state that:

the indemnity insurance or guarantee shall ensure that the insurer or the bank is directly liable for the damages the company incurs by negligence;

the indemnity insurance covers the company's operations in all countries within the European Union and countries with which the Community has concluded an agreement within the financial territory;

the indemnity insurance or the guarantee shall include cover for a revocation of the cover sum in the event that it may depleted as a result of one or more injuries during an insurance year (policy-backed reinstatement);

the indemnity insurance or the guarantee shall cover claims for damages that are raised and reported within 3 years after termination of the insurance or the guarantee, to the extent that no new indemnity insurance has been signed in another insurance company or provided a new guarantee for the intermediary in another bank with full retroactive coverage.

 

3.

Consultant's indemnity liability: Financial advisor

§ 2 of Executive Order no. 653 of 30/05/2018 on financial advisors', investments advisors and housing credit intermediaries insurance coverage, guarantee schemes and handling of entrusted funds.

The financial advisor must submit a declaration from the insurance company (form prepared by DFSA) with information about the requested indemnity insurance. By submitting this declaration, the insurance company guarantees that the indemnity insurance complies with the rules in §§ 2-5, cf. § 5.

The declaration must according to §§ 2-3 i.a. state that:

The liability insurance or guarantee shall ensure that the insurance company or the bank is directly liable to the injured party for the liability that a financial advisor, investment advisor or housing credit intermediary claims in the event of negligent circumstances expelled by the company or any party to whom it is liable;

The indemnity insurance covers the company's operations in Denmark;

The liability insurance or warranty shall cover claims that are raised and reported within 3 years after termination of liability insurance or warranty, insofar as no new liability insurance has been taken in another insurance company or a new guarantee for the company is given to another bank with full retroactive coverage;

The liability insurance or the guarantee shall include cover for a revocation of the cover sum in the event that it may be depleted as a result of one or more injuries during an insurance year (policy-backed reinstatement);

The sum insured is at least DKK 1 500 000 per claim per insurance year and at least DKK 3 000 000 for all claims per insurance year.

§ 2 of Executive Order no. 653 of 30/05/2018 on financial advisors', investments advisors and housing credit intermediaries insurance coverage, guarantee schemes and handling of entrusted funds.

The housing credit intermediary must submit a declaration from the insurance company (form prepared by DFSA) with information about the requested indemnity insurance. By submitting this declaration, the insurance company guarantees that the indemnity insurance complies with the rules in §§ 2-5, cf. § 5.

The declaration must according to §§ 2-3 i.a. state that:

Executive Order about information requirements in connection with commercial mortgages on real estate and certain mortgage dealers' treatment of entrusted funds and guarantees

It is a requirement that the company (ejendomskreditselskabet), dealing with consumers, set up a separate account for the agreed funds, and that the company has secured these funds. A declaration from an approved auditor concerning the security of the funds must be submitted to the DFSA annually, cf. § 3, para 5.

In order for a mortgage company to receive entrusted funds, cf. § 4-9 of the Executive Order no. 1241 of 8/11/2010 (about information requirements in connection with commercial mortgages on real estate and certain mortgage dealers' treatment of entrusted funds and guarantees), a declaration from an insurance company or bank that guarantees payment of entrusted funds is required, cf. § 10.

The declaration must according to § 10 i.a. state that:

The guarantor guarantees the right to require payment of entrusted funds that can be directed against the company by a consumer who is dealing with mortgages on property with the company;

The guarantee gives the insured a direct claim against the guarantor;

The guarantee must cover claims relating to the entrusted funds during the warranty period;

The guarantee must cover at least 1 year;

The guarantee is not subject to any restrictions other than those permitted by this Executive Order.

§ 773 Insurance policy

(1)

The existence of a liability insurance contract shall be evidenced by an insurance policy carried on board the ship.

(2)

A policy of liability insurance shall include the following information:

1)

name of the ship, her IMO number and the port of registry;

2)

name and principal place of business of the shipowner;

3)

type and duration of liability insurance;

4)

name and principal place of business of the insurance undertaking.

(3)

The insurance policy of a ship flying the national flag of Estonia shall be either in English or in Estonian and English.

§ 775 Certificate of validity of liability insurance in case of causing loss of life, damage to health or bodily injury of passenger

(1)

In case of international carriage of passengers, a respective certificate shall be applied for from the Estonian Maritime Administration to prove the existence and validity of the liability insurance or other financial security that meets the requirements provided for in subsection 774 (1) of this Act. If the liability insurance contract or another financial security contract meets the requirements provided for in subsection 774 (1) of this Act, the Estonian Maritime Administration shall issue a certificate regarding the existence and validity of the liability insurance or other financial security (hereinafter certificate of liability insurance or other financial security). If the requirements are not met, the Estonian Maritime Administration shall refuse to issue the certificate.

(2)

A certificate of liability insurance or other financial security shall be issued for a term that shall not exceed the term of the liability insurance contract or other financial security contract, on the basis whereof the certificate is issued.

(3)

The procedure for application for, issue, revocation and maintenance of a certificate of liability insurance or other financial security, and the form of the certificate shall be established by a regulation of the Minister of Economic Affairs and Communications.

(4)

A state fee shall be paid for the processing of an application for a certificate of liability insurance or other financial security.

According to Article 50 Paragraph 5 of the Act on Provision of Tourism Services (Official Gazette No. 130/2017) organizer shall provide to the traveller direct exercise of rights on refunds from the guarantee and, for evidence purposes of said right, hand over the contract or certificate of travel contract in package arrangement referred to in article 31 of this Act to the traveller which shall include statement on traveller's option to, based on the contract or the certificate of contract, directly exercise the rights on refund referred to in paragraph 1 of this Article from the insurance company or the bank, as well as include information on the insurer – insurance company or bank with their respective identification number, electronic address, phone number, the document number of provided guarantee (the number of the insurance policy or bank guarantee) and other information that may be required in order to activate the guarantee.

According to Article 53 Paragraph 2 of the Act on Provision of Tourism Services (Official Gazette No. 130/2017) organizer is obliged to provide information on liability insurance for damages, insured risks referred to in paragraph 1 of this Article, on the insurer – insurance company with its respective LEI number, electronic address and phone number, insurance policy number and other information necessary for the activation of the guarantee and the exercise of right on compensation in the contract or the certificate of travel contract in package arrangement referred to in Article 31 of this Act, which he is obliged to hand over to the traveller.

The applicant sends the Blue Card Bunker Oil insurance guarantee, as per the model referred to in Article 13(1)(d), to the Public Insurance Services Licensing Authority (Consap) in electronic form as an annex to the application referred to in Article 4 above. the name of the vessel, its registration number, identification letters or number and its port of registration;

(b)

the name of the qualified person referred to in Article 3 and their main place of business;

the IMO ship identification number;
