COUNCIL REGULATION (EU) 2022/148

of 3 February 2022

amending Regulation (EU) No 753/2011 concerning restrictive measures directed against certain individuals, groups, undertakings and entities in view of the situation in Afghanistan

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 215 thereof,

Having regard to the Council Decision 2011/486/CFSP of 1 August 2011 concerning restrictive measures directed against certain individuals, groups, undertakings and entities in view of the situation in Afghanistan (1),

Having regard to the joint proposal from the High Representative of the Union for Foreign Affairs and Security Policy and the European Commission,

Whereas:

Council Regulation (EU) No 753/2011 (2) gives effect to restrictive measures adopted within the United Nations framework.

(2)

On 22 December 2021, the United Nations Security Council adopted Resolution 2615 (2021) (UNSCR 2615 (2021)). That Resolution notably introduces a new exemption to the restrictive measures for humanitarian assistance and other activities that support basic human needs in Afghanistan.

On 3 February 2022, the Council adopted Decision (CFSP) 2022/153 (3), amending Decision 2011/486/CFSP in accordance with UNSCR 2615 (2021).

Those amendments fall within the scope of the Treaty and therefore regulatory action at the level of the Union is necessary in order to implement them, in particular with a view to ensuring their uniform application in all Member States.

Regulation (EU) No 753/2011 should therefore be amended accordingly,

HAS ADOPTED THIS REGULATION:

Article 1

In Article 3 of Regulation (EU) No 753/2011, the following paragraph is added:

‘4.   Paragraphs 1 and 2 shall not apply to the making available of funds or economic resources necessary to ensure the timely delivery of humanitarian assistance and other activities that support basic human needs in Afghanistan or to support such activities.’.

Article 2

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.
