COMMISSION DECISION

of 18 July 2018

on the proposed citizens’ initiative entitled ‘Permanent European Union Citizenship’

(Only the English text is authentic)

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 211/2011 of the European Parliament and of the Council of 16 February 2011 on the citizens’ initiative (1), and in particular Article 4 thereof,

Whereas:

The subject-matter of the proposed citizens’ initiative entitled ‘Permanent European Union Citizenship’ refers to the following: ‘European Union Citizenship’.

(2)

The objectives of the proposed citizens’ initiative refer to the following: ‘EU citizens elect the European Parliament and participate in its work, thus exercising treaty rights, enhancing Union democracy, and reinforcing its citizenship. Noting the ECJ’s view of Union citizenship as a ‘fundamental status’ of nationals of Member States, and that Brexit will strip millions of EU citizens of this status and their vote in European elections, requests the Commission propose means to avoid risk of collective loss of EU citizenship and rights, and assure all EU citizens that, once attained, such status is permanent and their rights acquired’.

The Treaty on European Union (TEU) reinforces citizenship of the Union and enhances further the democratic functioning of the Union by providing, inter alia, that every citizen is to have the right to participate in the democratic life of the Union by way of a European citizens’ initiative.

To this end, the procedures and conditions required for the citizens’ initiative should be clear, simple, user-friendly and proportionate to the nature of the citizens’ initiative so as to encourage participation by citizens and to make the Union more accessible.

A legal act of the Union for the purpose of implementing the Treaties can be adopted in the field of rights of third-country nationals residing legally in a Member State, including the conditions governing freedom of movement and of residence in other Member States of the EU. While such a legal act may not confer the right to vote or to stand as a candidate at elections to the European Parliament on citizens of a state that has withdrawn from the Union pursuant to Article 50 TEU, it may confer certain rights similar to rights of citizens of the Union to move and reside freely within the territory of the Member States on citizens of such state. Moreover, rights of EU citizens, who have already exercised their freedom of movement prior to the withdrawal of a Member State from the Union, and their family members, can be safeguarded in an agreement pursuant to Article 50 TEU.

The proposed citizens’ initiative does not fall manifestly outside the framework of the Commission’s powers to submit a proposal for a legal act of the Union for the purpose of implementing the Treaties in accordance with Article 4(2)(b) of the Regulation.

(7)

The proposed citizens’ initiative entitled ‘Permanent European Union Citizenship’ should therefore be registered,

HAS ADOPTED THIS DECISION:

Article 1

The proposed citizens’ initiative entitled ‘Permanent European Union Citizenship’ is hereby registered.

Article 2

This Decision shall enter into force on 23 July 2018.

Article 3

This Decision is addressed to the organisers (members of the citizens’ committee) of the proposed citizens’ initiative entitled ‘Permanent European Union Citizenship’, represented by Mr Anthony SIMPSON and Mr Dexter WHITFIELD acting as contact persons.

Update of reference amounts for the crossing of the external borders, as referred to in Article 6(4) of Regulation (EU) 2016/399 of the European Parliament and of the Council on a Union Code on the rules governing the movement of persons across borders (Schengen Borders Code) (1)

The publication of reference amounts for the crossing of the external borders, as referred to in Article 6(4) of Regulation (EU) 2016/399 of the European Parliament and of the Council of 09 March 2016 on a Union Code on the rules governing the movement of persons across borders (Schengen Borders Code), is based on the information communicated by the Member States to the Commission in conformity with Article 39 of the Schengen Borders Code.

In addition to the publication in the Official Journal, a monthly update is available on the website of the Directorate-General for Migration and Home Affairs.

POLAND

Replacement of the information published in OJ C 157, 27.5.2011

The amounts required to cross the external border are laid down in the Regulation of the Minister of the Interior of 23 February 2015 on the means of subsistence required from a foreigner entering the territory of the Republic of Poland and documents that can confirm the possibility of obtaining such means, as well as the purpose and duration of the planned stay (Journal of Laws of 2017, item 2122).

The above regulation stipulates that a foreigner entering the territory of the Republic of Poland must possess means of subsistence amounting to at least:

1.

PLN 300, if the duration of their planned stay does not exceed 4 days,

2.

PLN 75 for each day of the planned stay, if the duration of their planned stay exceeds 4 days

or the equivalent of this amount in foreign currency.

A foreigner entering the territory of the Republic of Poland who:

1.

is a participant in a tourist event, a youth camp or sports event,

2.

has had the cost of the stay in the Republic of Poland paid,

3.

comes to a treatment and sanatorium facility,

4.

is a participant in the program enabling to perform holiday work on the territory of the Republic of Poland, which is not the main purpose of their stay, governed by an international agreement to which the Republic of Poland is a party

must possess an amount of at least PLN 20 for each day of the planned stay, no less than PLN 100, or the equivalent of this amount in foreign currency.

A foreigner entering the territory of the Republic of Poland in order to take up or continue their studies, participate in scientific research or training, carry out development works as well as to take or continue education must possess an amount of at least PLN 1 270 for the first two months of their planned stay or the equivalent of this amount in foreign currency.

Moreover, the foreigner must possess additional financial resources to cover the costs of their return journey to the country of origin or residence as well as costs of their transit to a third country which will grant them entry, the minimum amount of which is (separately per foreigner and each member of their family):

1.

PLN 200, if they came from a country neighbouring the Republic of Poland,

2.

PLN 500, if they came from a Member State of the European Union other than neighbouring the Republic of Poland,

3.

PLN 2 500, if they came from a country that is not a Member State of the European Union

or the equivalent of this amount in foreign currency.

EFTA Surveillance Authority v The Kingdom of Norway

(Failure by an EFTA State to fulfil its obligations — Directive 2004/18/EC — Public procurement — Public contract — Public works concession)

In Case E-4/17, EFTA Surveillance Authority v The Kingdom of Norway — APPLICATION for a declaration that by incorrectly classifying a public contract, having as its subject matter the construction and operation of an underground car park under Torvet in Kristiansand, as a ‘service concession’ rather than as a ‘works concession’, and by carrying out a tender procedure which is not in line with the requirements under the EEA rules on public procurement, the Kingdom of Norway has breached provisions of the Act referred to at point 2 of Annex XVI to the Agreement on the European Economic Area (Directive 2004/18/EC of the European Parliament and of the Council of 31 March 2004 on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts) in conjunction with the Act referred to at point 6a of Annex XVI to the Agreement (Regulation (EC) No 2195/2002 of the European Parliament and of the Council of 5 November 2002 on the Common Procurement Vocabulary (CPV)), the Court, composed of Páll Hreinsson, President and Judge-Rapporteur, Per Christiansen and Nicole Kaiser (ad hoc), Judges, gave judgment on 21 March 2018, the operative part of which is as follows:

The Court hereby:

1.

Declares that the Kingdom of Norway has, in relation to a tender procedure carried out by the Municipality of Kristiansand in 2015 for the construction and operation of an underground car park under Torvet in Kristiansand, failed to fulfil its obligations under Directive 2004/18/EC of the European Parliament and of the Council of 31 March 2004 on the coordination of procedures for the award of public works contracts, public supply contracts and public service contracts, referred to at point 2 of Annex XVI to the Agreement on the European Economic Area, by failing to:

(i)

publish a contract notice throughout the EEA in accordance with the legal requirements laid down in Article 58(3) of the Directive;

(ii)

use a complete and sufficiently precise set of CPV codes, in breach of Article 58(2) of the Directive, in conjunction with Article 1(14) of the Directive and Regulation (EC) No 2195/2002 of the European Parliament and of the Council of 5 November 2002 on the Common Procurement Vocabulary (CPV), referred to at point 6a of Annex XVI to the EEA Agreement; and

(iii)

respect the minimum time limit for the submission of applications in an award procedure, as prescribed by Article 59 of the Directive.

2.

Orders the Kingdom of Norway to bear the costs of the proceedings.

Prior notification of a concentration

Candidate case for simplified procedure

1.   

On 18 July 2018, the Commission received notification of a proposed concentration pursuant to Article 4 of Council Regulation (EC) No 139/2004 (1).

This notification concerns the following undertakings:

S.L.04 S.à. r.l. (‘SL04’, Luxembourg), indirectly controlled by L Catterton Partners (‘L Catterton’, U.S.),

Ambienta Sgr S.p.A. (‘Ambienta’, Italy), controlled by Ambienta Holding S.r.l. (Italy),

Pibinew S.r.l. (‘Pibinew’, Italy).

SL04 and Ambienta acquire within the meaning of Article 3(1)(b) and 3(4) of the Merger Regulation joint control of Pibinew. The concentration is accomplished by way of a purchase of shares in a newly created company constituting a joint venture.

2.   

The business activities of the undertakings concerned are:

—   for SL04: a private equity firm indirectly controlled by L Catterton whose portfolio companies operate in the retail and restaurant business, the food and beverage business, consumer service and consumer product businesses including the production and sale of cosmetics and fragrance products,

—   for Ambienta: a private equity firm whose portfolio includes companies operating in the renewable power, biofuels, energy efficiency, pollution mitigation, and waste and water resource management sectors,

—   for Pibinew: designing, manufacturing, decorating and selling plastic packaging for the cosmetic industry.

On preliminary examination, the Commission finds that the notified transaction could fall within the scope of the Merger Regulation. However, the final decision on this point is reserved.

Pursuant to the Commission Notice on a simplified procedure for treatment of certain concentrations under the Council Regulation (EC) No 139/2004 (2) it should be noted that this case is a candidate for treatment under the procedure set out in the Notice.

4.   

The Commission invites interested third parties to submit their possible observations on the proposed operation to the Commission.

Observations must reach the Commission not later than 10 days following the date of this publication. The following reference should always be specified:
