COUNCIL COMMON POSITION 2008/479/CFSP
of 23 June 2008
amending Common Position 2007/140/CFSP concerning restrictive measures against Iran
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on European Union, and in particular Article 15 thereof,
Whereas:
(1) |
Following the adoption of United Nations Security Council Resolution 1737 (2006), the Council of the European Union adopted on 27 February 2007 Common Position 2007/140/CFSP concerning restrictive measures against Iran (1). |
(2) |
The prohibition on making funds or economic resources available to the persons and entities subject to restrictive measures should not prevent payments to frozen accounts due under contracts, agreements or obligations that were concluded or arose before the date on which those accounts became subject to restrictive measures provided that any such payments also remain frozen. |
(3) |
The Council has identified additional persons and entities that fulfil the criteria set out in Articles 4(1)(b) and 5(1)(b) of Common Position 2007/140/CFSP. These persons and entities should therefore be listed in Annex II to that Common Position, |
HAS ADOPTED THIS COMMON POSITION:
Article 1
Common Position 2007/140/CFSP is hereby amended as follows:

in Article 5, subparagraph (b) of paragraph 5 shall be replaced by the following:

Annex II to Common Position 2007/140/CFSP shall be replaced by the text appearing in the Annex to this Common Position. |
Article 2
This Common Position shall take effect on the date of its adoption.
Article 3
This Common Position shall be published in the Official Journal of the European Union.

Iran has refused to provide the IAEA access to a document on the production of uranium metal hemispheres, only applicable for nuclear weapons use. |
