COUNCIL IMPLEMENTING REGULATION (EU) 2024/1746

of 24 June 2024

implementing Regulation (EU) No 269/2014 concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Regulation (EU) No 269/2014 of 17 March 2014 concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine (1), and in particular Article 14(1) thereof,

Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

On 17 March 2014, the Council adopted Regulation (EU) No 269/2014.

In its conclusions of 21 and 22 March 2024, the European Council reaffirmed the Union’s steadfast support for Ukraine’s independence, sovereignty and territorial integrity within its internationally recognised borders and recognised Ukraine’s inherent right of self-defence against the Russian aggression. The European Council also called for further steps to weaken Russia’s ability to continue waging its war of aggression, including by strengthening the sanctions.

In view of the gravity of the situation, it is appropriate to adopt further restrictive measures.

In particular, the Council considers that 69 persons and 47 entities responsible for actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine should be added to the list of persons, entities and bodies subject to restrictive measures set out in Annex I to Regulation (EU) No 269/2014.

Regulation (EU) No 269/2014 should therefore be amended accordingly,

HAS ADOPTED THIS REGULATION:

Article 1

Annex I to Regulation (EU) No 269/2014 is amended in accordance with the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the date of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

He himself has spoken aggressively and in a biased manner against the democratically elected authorities of Ukraine and has always emphasised his full support for Russia’s aggressive policy towards Ukraine. He has been actively involved in multiple projects conducted in occupied Ukrainian territories for media specialists, such as the “Academy of Emotions” funded by the Presidential Fund for Cultural Initiatives and established to promote the war. His company Mash manages regional publications of the Mash propaganda project. He is also a sponsor of the WarGonzo Z-military project, whose correspondents have been conducting anti-Ukrainian propaganda since the beginning of the war. Therefore, Aram Gabrelyanov is supporting and implementing actions and policies which undermine and threaten the territorial integrity, sovereignty and independence of Ukraine.

Vadim Yakovenko is Head of the Federal Agency for State Property Management (Rosimushchestvo), a Russian federal executive body managing federal property, which organises the sale of federal property to be privatised and property seized in accordance with a court decision or directives of other agencies. Rosimuschestvo is responsible for taking control over multiple Western assets with Decree No. 302 “On Temporary Management of Certain Property” signed by the President of the Russian Federation Vladimir Putin. That decree was signed to ensure the stable functioning of the Russian energy sector and the uninterrupted operation of companies significant for the Russian economy. In addition, Rosimuschestvo contributes significantly to the revenue of the Russian Federation.

As Head of Rosimuschestvo, Vadim Yakovenko is supporting, materially and financially, and benefitting from the Government of the Russian Federation, which is responsible for the annexation of Crimea and the destabilisation of Ukraine.

Furthermore, Rosimuschestvo is actively involved in contributing aid to the activities of the Russian Federation in the occupied Ukrainian territories of Donbas. As Head of Rosimuschestvo, Vadim Yakovenko is supporting and implementing actions and policies which undermine and threaten the territorial integrity, sovereignty and independence of Ukraine.

JSC Hydromash fulfils Russian state defence orders, and its products (chassis and other hydraulic units) are used by the Armed Forces of the Russian Federation. Valery Tyulin is the General Director of Joint Stock Company (JSC) FNPTS NNIIRT. JSC FNPTS NNIIRT is part of the Almaz-Antey concern. 1L125 “Niobium-SV” locators, from the “Nebo” family of locators, created by JSC FNPTS NNIIRT, are used in Russia’s war of aggression against Ukraine. JSC FNPTS NNIIRT has been developing a new radar for military air defence, which has received the current designation “Niobium-SV”. Those new radars are in service in the Russian army. In her re-education programmes, she cooperates with Ramsan Kadyrov and the “Movement of the First”, a state-led youth organisation in the Russian Federation, which was created in December 2022 at the initiative of President of the Russian Federation Vladimir Putin to provide educational activities, including of a militarised nature, for children between the ages of 6 to 18, based on “traditional Russian spiritual and moral goals”.

Furthermore, Olga Koludarova aims to synchronise the legislation of the so-called “Donetsk People’s Republic” and the Russian Federation in the educational sphere. Therefore, Olga Koludarova is supporting and implementing actions and policies that undermine the territorial integrity and sovereignty of Ukraine.

Those products are widely used and compatible with military weaponry used by Russia.

JSC BelOMO LEMT EMT is also part of the BelOMO holding. OJSC Belarusian Optical and Mechanical Association BelOMO is a state-owned enterprise that operates in the defence sector in Belarus, producing and selling optical sights for small arms, including telescopic sights and optical sights with illuminated reticles.

BelOMO operates as the management company for several other defence sector entities.

OJSC “Minsk Mechanical Plant named after S.I. Vavilov” is an enterprise of the BelOMO holding that specialises in military purpose optical equipment. It assembled the PVKU-210 drive rotating contact device. The PVKU-210 is a part of a panoramic sight that is used for advanced models of modern tanks. The product is supplied to JSC Peleng, an entity subject to restrictive measures that provides military sights to tank plant Uralvagonzavod.

JSC “Zenit-BelOMO”, Vileyka is another enterprise of the BelOMO holding that specialises in military purpose optical equipment. It manufactures military sights, including PM-10 and PM-25 mortar sights, PGO-7V3 optical sight for grenade launcher, and PSO-1M2 Sniper optical sight. Those products are widely used and compatible with military weaponry used by Russia.

JSC BelOMO LEMT EMT is also part of the BelOMO holding. It specialises in the research and development, production and modernisation of optoelectronic and laser devices for unmanned aerial vehicles, laser-optical systems for air defence systems, and integrated border security and protection systems. BelOMO LEMT EMT also produces optical sights and systems for light armament, laser rangefinders, range-finding modules based on diode lasers, and laser fire control systems, including specifically for Russian weapons. BelOMO LEMT EMT also exports to Russia and is developing new laser weapons together with Russia.

Therefore, OJSC “Belarusian Optical and Mechanical Association” is responsible for supporting materially or financially actions which undermine or threaten the territorial integrity, sovereignty and independence of Ukraine.

Novaport thus supports the Russian Government in providing logistical infrastructure for the Russian Air Force and undermines the territorial integrity of Ukraine by promoting flights between its airports and airports in illegally annexed Crimea.

Such services provide a substantial source of revenue to the Government of the Russian Federation, accounting for more than 70 % of Russia’s energy revenue, thereby enabling the Kremlin to finance its war of aggression against Ukraine.

Therefore, Sovcomflot is supporting, materially and financially, the Government of the Russian Federation. Moreover, Sovcomflot is involved in an economic sector providing a substantial source of revenue to the Government of the Russian Federation.
