THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2022/2379 of the European Parliament and of the Council of 23 November 2022 on statistics on agricultural input and output, amending Commission Regulation (EC) No 617/2008 and repealing Regulations (EC) No 1165/2008, (EC) No 543/2009 and (EC) No 1185/2009 of the European Parliament and of the Council and Council Directive 96/16/EC (1), and in particular Article 4(6), Article 5(10), Article 7(2), Article 7(3) and Article 9(4) thereof,
Whereas:

Regulation (EU) 2022/2379 establishes an integrated framework for the development, production and dissemination of European statistics related to agricultural inputs and outputs. In order to ensure that comparable data are produced by Member States and to achieve harmonisation within the agricultural statistics system, it is necessary to specify the technical elements of the statistics on agricultural inputs and outputs as regards animal production to be transmitted to the Commission (Eurostat). |

These elements consist of the list of variables, the descriptions of the variables, the observation units, the precision requirements to be applied, the methodological rules to be applied, and the deadlines for transmitting the data, where appropriate. |

(3) |
When setting up the data collection systems, Member States should favour options that minimise the number of confidential values in their data. |
|
(4) |
It is necessary to specify the variables for which the regional and organic dimensions are required as they are needed only for some variables. |
|
(5) |
The coverage of the data sets should be specified beyond the requirements in Article 4(2) of Regulation (EU) 2022/2379, where appropriate, to avoid inconsistencies between Member States. |
|
(6) |
The reference periods mentioned in Article 9(4) of Regulation (EU) 2022/2379 should be further specified to ensure comparability of the statistics between Member States. |
|
(7) |
Pursuant to Article 7(2) of Regulation (EU) 2022/2379, Member States can be exempted from providing specific data for predefined variables at certain deadlines if the impact of these Member States on the Union total of those variables is limited. This is the case if their production is below specific thresholds. It is necessary to specify those thresholds, the methodology used to set them up, the sources of data used in applying this methodology, and the data to which this exemption applies. |

Pursuant to Article 7(3) of Regulation (EU) 2022/2379, Member States can also be exempted from transmitting specific data for predefined variables where their impact in relation to the agricultural production at national or regional level is limited. It is necessary to specify reference threshold values for the variables subject to exemptions. |

(9) |
Quality requirements should be proportionate and ensure that the cost and burden of producing statistics stays reasonable. Therefore, while Regulation (EU) 2022/2379 requires that all statistics be representative of the statistical population of the relevant geographical area, only some of the required variables should be subject to further precision requirements in this Regulation. |

(10) |
The measures provided for in this Regulation are in accordance with the opinion of the European Statistical System Committee as established by Article 7 of Regulation (EC) No 223/2009 of the European Parliament and of the Council (2), |
HAS ADOPTED THIS REGULATION:
Article 1
Data requirements
Member States shall provide data on the domain of animal production statistics referred to in Article 5(1), point (a) of Regulation (EU) 2022/2379 in the form of aggregated data sets. The data on total and organic production shall be transmitted to the Commission (Eurostat) at the required geographical level referred to in Article 5(10), point (b)(iii), of Regulation (EU) 2022/2379, and as set out in Annexes I, II and III.
Article 2
Datasets
1. The data contents of the datasets are specified in:

2. For each dataset, Section I specifies:

(a) |
a description of the data contents; |
|
(b) |
the variables to be provided at national and, where required, at regional level; |
|
(c) |
the variables to be provided on organic production; |
|
(d) |
the deadlines for transmission of the data to the Commission (Eurostat); |
|
(e) |
the reference periods. |
3. For each dataset, Section II specifies, where appropriate:
|
(a) |
a description of the measurement units; |
|
(b) |
technical requirements related to the variables; |
|
(c) |
thresholds for exemptions to data transmission deadlines; |
|
(d) |
thresholds for regional data transmissions; |
|
(e) |
coverage specifications. |
4. For each dataset, Section III specifies methodological rules, where relevant.
Article 3
Precision requirements
1. When data collections are conducted based on statistical samples, Member States shall ensure that the weighted results are representative of the statistical population within the relevant geographical unit and are designed to meet the precision requirements set out in Annex IV.
2. Where precision requirements are not applicable, for example due to sources other than statistical surveys, Member States shall ensure that the statistics are representative of the scope that they describe and meet the quality criteria laid down in Article 12(1) of Regulation (EC) No 223/2009.
Article 4
Descriptions
For the purpose of this Regulation, the descriptions of terms as set out in Annex V shall apply.
Article 5
Methodology for exemptions
1. The Commission shall grant data transmission exemptions for variables or groups of variables in datasets of the topics (i) livestock and meat, (ii) eggs and chicks, and (iii) milk and milk products. Those exemptions shall be based on reference threshold values and shall be granted if their application does not reduce the information on the expected EU total of the corresponding variable by more than 5 %. The reference threshold values for the variables subject to exemptions shall be those laid down in each Section II of Annexes I, II and III. The Commission (Eurostat) shall calculate reference threshold values for those variables based on a three-year average of statistical data. If annual data are not available for that three-year period, the threshold shall refer to other data for the same period, representative at the required geographical level as set out in Annexes I, II and III, to be provided by the Member State or States in question.
2. A Member State where the value of a variable has been lower than or equal to the reference threshold value for three successive years shall be exempted from transmitting data on this variable for the deadlines set out in each Section II of the data sets in Annexes I, II and III. The exemption shall be automatically revoked if the value of the variable for the Member State exceeds the reference threshold value for three successive years. The Member State shall start transmitting data on that variable for the reference year following the third consecutive year in which the reference threshold value is exceeded. The exemption shall be automatically reinstated if the value of the variable for the Member State is lower or equal to the reference threshold value for three successive years. If annual data are not available at the Commission for that three-year period, the Member State or States in question shall provide other data representative at the required geographical level as set out in Annexes I, II and III.
3. The Commission may amend any of these reference threshold values if the average EU total stays lower than 90 % or higher than 110 % of the EU total used for calculating the reference threshold values for three successive years. If annual data are not available at the Commission for that three-year period, the Member State or States in question shall provide representative national data for the calculation of that total.
4. The Commission shall grant exemptions to Member States for predefined variables in the event that the impact of the variable is limited in relation to the agricultural production at national or regional level. Those exemptions shall be based on reference threshold values as laid down in Section II of Annex III.
Article 6
Entry into force
This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.
It shall apply from 1 January 2025.
This Regulation shall be binding in its entirety and directly applicable in all Member States.

SECTION II
Description of the measurement units
Number of animals refers to the total number of animals that are held on agricultural holdings, excluding animals in transport or in slaughterhouses.
Number of organic animals refers to animals that are fully compliant with the principles and rules of organic production and raised under certified organic management at farm level, as set out in (i) Regulation (EU) 2018/848 of the European Parliament and of the Council (2) or, where applicable, in the most recent Union legislation and (ii) the corresponding national implementing rules. These animals are included in the total number of animals.
Average number of animals refers to the average daily number of animals that are held on agricultural holdings, excluding animals in transport or in slaughterhouses. This number shall take into account seasonal fluctuations, as well as temporary breaks in production.

Regional data transmission
Member States shall provide regional data:

SECTION II
Description of the measurement units
Number of slaughtered animals: The number of carcasses of animals whose meat is deemed fit for human consumption.
Carcass weight: The cold carcass weight of slaughtered animals whose meat is deemed fit for human consumption.
Organic animals refer to animals that are fully compliant with the principles and rules of organic production and raised under certified organic management on agricultural holdings in the Member State and certified as organic according to (i) Regulation (EU) 2018/848 or, where applicable, in the most recent Union legislation and (ii) the corresponding national implementing rules. The slaughtered organic animals are those slaughtered on the territory of the same Member State. They are accounted for in the total numbers of slaughtered animals.

Data contents
The data shall cover the gross indigenous production (GIP) forecast, meaning the number of animals expected to be delivered by the framework of agricultural holdings of a Member State abroad or to the slaughterhouses in the Member State, or to be otherwise slaughtered. Slaughtered animals not fit for human consumption shall be excluded.

SECTION III

The achieved GIP may be established, for each livestock category, as the animals slaughtered in a Member State plus the trade balance (exports minus imports) of intra- and extra-Union trade for this livestock category.

Description of the measurement units
Number of eggs for consumption produced refers to the number of chicken eggs aimed for consumption produced by the agricultural holdings in a Member State, covering those received by packing centres from egg producers in the Member State and those directly delivered or used by agricultural holdings.
Number of eggs for consumption from certified organic production refers to eggs for consumption that originate from animals that are fully compliant with the principles and rules of organic production at farm level, as set out in (i) Regulation (EU) 2018/848 or, where applicable, in the most recent Union legislation and (ii) the corresponding national implementing rules. These eggs are included in the total numbers.
Data transmission exemptions
Member States that use information from packing centres or other administrative sources are exempted from implementing the threshold. In this case, the provided number of eggs shall cover all the eggs for consumption produced by all agricultural holdings in that Member State. Where the number of eggs received by the packing centres is used, the quantity produced shall include eggs directly delivered by the agricultural holdings to the agri-food industry or to consumers, as well as any other use of non-marked eggs for consumption during the reference period.

Number of chicks intended for use refers to day chicks produced in a Member State by intended use (based on the genetic type), including those exported for use in another country. Eggs sold by hatcheries just before hatching are included.
Number of chicks, imports refers to the number of chicks imported by a Member State from another EU Member State (intra-Union) or from a third country (extra-Union).
Number of chicks, exports refers to the number of chicks exported from a Member State to another EU Member State (intra-Union) or to a third country (extra-Union).

Delivery to and return by the dairy enterprises shall include delivery to and return by foreign dairy enterprises. Where the corresponding values are collected from the national dairy sector, activities related to foreign dairy enterprises shall also be considered.

Quantities of used whole and skimmed milk refers to the quantities used for producing the various milk products.
Quantity of (fat) milk products in butter equivalent refers to the quantity of 82 %-fat butter that would be obtained with the fat matter of those milk products.
Quantity of whey in powder equivalent refers to the quantity of 5 %-moisture whey powder that would be obtained with that whey.
Where applicable, the quantities of other milk products may be set to zero if they are produced from milk products already reported under another heading of data set iii.3 part 2.
Total uses = availabilities refers to the total availabilities as reported in data set iii.2. The quantities of available milk fat, milk protein, and milk (to be) used from other collected or imported milk products are included here where significant.
Statistical differences and losses are the differences between the reported availabilities and uses, so that availabilities and uses are balanced after integrating these values.

SECTION III
Methodological rules
The uses of milk and dairy materials by the dairy sector shall be coherent with the availabilities to the dairy sector and with the quantities of dairy products obtained.
Where the absolute value of the variable ‘statistical differences and losses’ in part 1 represents more than 1 % of the available milk, the differences between availabilities and uses shall be explained so that the differences stay unexplained for at most 1 % of milk available. That explanation shall be provided as metadata with the same deadline as the data.
For categories where fat and protein content is transmitted for all used milks, input of whole milk and of skimmed milk is not mandatory.
Where a process generates skimmed milk (e.g. butter making) the quantity of used skimmed milk is reported as negative.

The size of the dairy enterprises relates to:

Volume of milk collected: Weight of milk collected in bulk direct from agricultural holdings during the calendar year, including direct collection from agricultural holdings in other Member States. |

Volume of milk treated: Weight of raw milk and raw dairy materials (in milk equivalent) used by a dairy enterprise during the calendar year. |

|
Volume of milk products produced: Weight of milk products produced by a dairy enterprise during the calendar year. |
Description of the measurement units
Number of dairy enterprises, except collection centres refers to the dairy enterprises situated in the Member State during the reference period.
Number of collection centres refers to the number of collection centres in the Member State during the reference period.
Quantity of products refers to the quantity of the various products obtained during the reference period.
Quantity treated refers to the quantity of milk processed during the reference period.
Coverage
The data shall cover 95 % of the milk collected, of the treated milk, or of the appropriate milk products produced in the Member State.
(1) The exempted Member States shall transmit the data for the reference years ending with 3, 6 and 0.
(*1) Uses of milk, fat and protein contents for processed cheese and whey refer to additional input, if any, of dairy materials, not yet accounted with cheese.
(2) Reference period covers six monthly periods where monthly data transmission is not required.
(3) The exempted Member States shall provide the data by 15 August for the monthly periods from January to June of the same year, and by 15 February for the monthly periods from July to December of the previous year.
ANNEX IV
Precision requirements
Data collected for a sample and extrapolated to the entire statistical population of a data set shall meet the precision requirements presented in Table 1.
The precision requirements apply to the final transmission of the national estimates for specific variables belonging to the data sets listed in Table 1.
The variables refer to the number of livestock heads, number of eggs and quantity of milk depending on the data set.
The relevant populations are defined in the first column of Table 1.

The milk and milk products delivered by an agricultural holding to a dairy enterprise, in the same or another Member State. |

‘Milk and milk products collected’ |
The milk and milk products collected by a dairy enterprise from an agricultural holding, in the same or in another Member State. |
||||||||||
|
‘Milk and milk products imported’ |
The milk and milk products received by a dairy enterprise from another Member State or a third country and not accounted as collected. |
||||||||||
|
‘Organic milk’ |
Milk that originates from organic animals that are fully compliant with the principles and rules of organic production and raised under certified organic management at farm level as set out in Regulation (EU) 2018/848 and collected or otherwise used in an organic certified process as organic. |

‘Direct use of whole milk on agricultural holdings’ |
Milk produced but not delivered to the dairy sector. |

‘Cream’ |
A film of fat which forms naturally on the surface of the milk by slow agglomeration of emulsifying fat globules. If it is removed by skimming it from the surface of the milk or extracted from the milk by centrifuging in a cream separator, it has, in addition to the other components of the milk, a relatively high fat content (usually exceeding 10 % of the weight of the product). |

‘Cream for consumption’ |
Cream that has been processed and is available for delivery outside the dairy sector (i.e. for human consumption, as raw material for manufacturers of chocolate, ice cream, etc.). In the same way as for other products, it does not include intermediate production intended for the manufacture of other dairy products. |

‘Other milk products’ |
Other milk products whose use is not elsewhere counted, i.e. with the exception of milk and cream (liquid, concentrated or powdered), acidified milk, cheese, processed cheese, whey (liquid, concentrated or powdered), buttermilk, butter and other yellow fat products.
