COMMISSION IMPLEMENTING REGULATION (EU) 2018/1889

of 4 December 2018

on the extension of the transitional periods related to own funds requirements for exposures to central counterparties set out in Regulations (EU) No 575/2013 and (EU) No 648/2012 of the European Parliament and of the Council

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 575/2013 of the European Parliament and of the Council of 26 June 2013 on prudential requirements for credit institutions and investment firms and amending Regulation (EU) No 648/2012 (1), and in particular Article 497(3) thereof,

Whereas:

In order to avoid disruption to international financial markets and to prevent penalising institutions by subjecting them to higher own funds requirements during the processes of recognition of existing third-country central counterparties (CCPs), Article 497(2) of Regulation (EU) No 575/2013 established a transitional period during which third-country CCPs with which institutions established in the Union clear transactions may be considered qualifying CCPs by those institutions.

Regulation (EU) No 575/2013 amended Regulation (EU) No 648/2012 of the European Parliament and of the Council (2) in respect of certain inputs to the calculation of institutions' own funds requirements for exposures to third-country CCPs. Accordingly, Article 89(5a) of Regulation (EU) No 648/2012 requires certain third-country CCPs to report, for a limited period of time, the total amount of initial margin they have received from their clearing members. That transitional period mirrors the one laid down in Article 497(2) of Regulation (EU) No 575/2013.

Both transitional periods were set to expire on 15 June 2014.

Article 497(3) of Regulation (EU) No 575/2013 empowers the Commission to adopt an implementing act to extend the transitional period for own funds requirements by six months in exceptional circumstances. That extension should also apply in respect of the time limits laid down in Article 89(5a) of Regulation (EU) No 648/2012. Those transitional periods have most recently been extended until 15 December 2018 by Commission Implementing Regulation (EU) 2018/815 (3).

Of the CCPs established in third countries that have already applied for recognition in accordance with Article 25 of Regulation (EU) No 648/2012, 32 CCPs have been recognised by the European Securities and Markets Authority. The remaining third-country CCPs are still awaiting recognition and their recognition process will not be completed by 15 December 2018. If the transitional period is not extended, institutions established in the Union (or their subsidiaries established outside the Union) having exposures to those remaining third-country CCPs will be required to increase their own funds for those exposures significantly, potentially leading to the withdrawal of those institutions as direct participants in those CCPs or, at least temporarily, to the cessation of the provision of clearing services to those institutions' clients and thus cause severe disruption in the markets in which those CCPs operate.

The need to avoid disruption to markets outside of the Union that led to the previous extensions of the transitional period laid down in Article 497(2) of Regulation (EU) No 575/2013 would therefore remain after the expiry of the extension of the transitional period set out in Implementing Regulation (EU) 2018/815. A further extension of the transitional period should enable institutions established in the Union (or their subsidiaries established outside the Union) to avoid significant increase in the own funds requirements due to the lack of completion of the recognition process for CCPs which provide, in a viable and accessible way, the specific type of clearing services that institutions established in the Union (or their subsidiaries established outside the Union) require. An additional six-month extension of the transitional periods is therefore appropriate.

This Regulation should enter into force before 16 December 2018 to ensure that the extension of the existing transitional periods occurs prior to their expiry. A later entry into force could lead to disruption for CCPs, for markets in which they operate and for institutions which have exposures to those CCPs.

The measures provided for in this Regulation are in accordance with the opinion of the European Banking Committee,

HAS ADOPTED THIS REGULATION:

Article 1

The 15-month periods referred to in Article 497(2) of Regulation (EU) No 575/2013 and in the second subparagraph of Article 89(5a) of Regulation (EU) No 648/2012, as most recently extended in Implementing Regulation (EU) 2018/815, are extended by an additional six months until 15 June 2019.

Article 2

This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COUNCIL DECISION (EU) 2018/1890

of 29 November 2018

amending Decision 1999/70/EC concerning the external auditors of the national central banks, as regards the external auditors of De Nederlandsche Bank

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to Protocol No 4 on the Statute of the European System of Central Banks and of the European Central Bank, annexed to the Treaty on European Union and the Treaty on the Functioning of the European Union, and in particular Article 27.1 thereof,

Having regard to the Recommendation of the European Central Bank of 19 October 2018 to the Council of the European Union on the external auditors of De Nederlandsche Bank (ECB/2018/25) (1),

Whereas:

The accounts of the European Central Bank (ECB) and of the national central banks of the Member States whose currency is the euro are to be audited by independent external auditors recommended by the Governing Council of the ECB and approved by the Council of the European Union.

(2)

The mandate of De Nederlandsche Bank's current external auditors, Deloitte Accountants B.V, will expire following the audit for the financial year 2018. It is therefore necessary to appoint external auditors from the financial year 2019.

(3)

De Nederlandsche Bank has selected KPMG Accountants N.V. as its external auditors for the financial years 2019 to 2022, with the option to extend the mandate on a yearly basis until the financial year 2025.

(4)

The Governing Council of the ECB recommended that KPMG Accountants N.V. be appointed as the external auditors of De Nederlandsche Bank for the financial years 2019 to 2022, with the option to extend the mandate on a yearly basis until the financial year 2025.

(5)

Following the recommendation of the Governing Council of the ECB, Council Decision 1999/70/EC (2) should be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

In Article 1 of Decision 1999/70/EC, paragraph 8 is replaced by the following:

‘8.   KPMG Accountants N.V. are hereby approved as the external auditors of De Nederlandsche Bank for the financial years 2019 to 2022.’.

Article 2

This Decision shall take effect on the date of its notification.

Article 3

This Decision is addressed to the ECB.

amending Implementing Decision 2014/403/EU on granting derogations to Member States with respect to the transmission of statistics pursuant to Regulation (EU) No 549/2013 of the European Parliament and of the Council concerning the European system of national and regional accounts in the European Union

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 549/2013 of the European Parliament and of the Council of 21 May 2013 on the European system of national and regional accounts in the European Union (1), and in particular Article 6(1),

Having regard to Commission Implementing Decision 2014/403/EU of 26 June 2014 on granting derogations to Member States with respect to the transmission of statistics pursuant to Regulation (EU) No 549/2013 of the European Parliament and of the Council concerning the European system of national and regional accounts in the European Union (2),

Whereas:

Pursuant to Article 6(1) of Regulation (EU) No 549/2013 Implementing Decision 2014/403/EU granted temporary derogations to Member States on the basis of requests justified by the need for major adaptations to national administrative and statistical systems in order to fully comply with that Regulation.

(2)

Pursuant to Article 6(3) of Regulation (EU) No 549/2013, the Commission checked the justifications for the granted derogations, consulted the European Statistical System Committee and adopted a report on the application of the granted derogations (3).

(3)

In accordance with that report, the availability of data under Regulation (EU) No 549/2013 has improved and most Member States have adapted its national administrative and statistical systems and have started providing all or some of the data covered by derogations even before the first transmission date.

(4)

Of the 365 derogations expiring in 2018, 2019 or 2020, 244 derogations (67 %) have valid justifications and should remain unchanged, 98 derogations (27 %) should be withdrawn since they no longer have any valid justifications, and the scope of 23 derogations (6 %) should be narrowed since their justifications are only partially valid.

Implementing Decision 2014/403/EU should therefore be amended accordingly.

The measures provided for in this Decision are in accordance with the opinion of the European Statistical System Committee,

HAS ADOPTED THIS DECISION:

Article 1

The Annex to Implementing Decision 2014/403/EU is replaced by the text set out in the Annex to this Implementing Decision.

Article 2

Article 3

This Decision shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

COMMISSION IMPLEMENTING DECISION (EU) 2018/1892

on a measure taken by Latvia in accordance with Directive 2006/42/EC of the European Parliament and of the Council to prohibit the placing on the market of a lawnmower manufactured by GGP Italy SpA

(notified under document C(2018) 7656)

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Directive 2006/42/EC of the European Parliament and of the Council of 17 May 2006 on machinery, and amending Directive 95/16/EC (1), and in particular Article 11(3) thereof,

Whereas:

On 1 July 2014, Latvia informed the Commission of a measure to prohibit the placing on the market of a lawnmower of type Stiga Collector 35 EL (C350, 297352654/S13), manufactured by GGP Italy SpA, via del Lavoro 6, 31033 Castelfranco Veneto, Italy.

Latvia took the measure on 3 December 2013 considering that the lawnmower was not conform to the essential health and safety requirements set out in points 1.3.8 and 1.4.1 of Annex I to Directive 2006/42/EC as it failed to conform to harmonised standard EN 60335-2-77:2010.

By means of Commission Implementing Decision (EU) 2015/902 (2), the Commission found the measure taken by Latvia justified.

By its judgement of 26 January 2017 (3), the General Court annulled Implementing Decision (EU) 2015/902 on the grounds that the Decision was not based on a clear demonstration of an infringement of the essential health and safety requirements set out in Directive 2006/42/EC but on the mere non-conformity of the lawnmower with harmonised standard EN 60335-2-77:2010 while harmonised standard EN 60335-2-77:2006 still conferred on it a presumption of conformity with those requirements during the period concerned (i.e. from 3 September 2012 until 31 August 2013) (4).

In order to fulfil the obligation laid down in Article 266 of the Treaty on the Functioning of the European Union, the Commission is required to take the necessary measures to comply with the judgment of the General Court.

To that end, the Commission consulted the concerned parties.

The manufacturer confirmed that the lawnmower has not been manufactured or placed on the market in any EU Member State since 1 September 2013. The manufacturer confirmed that the lawnmower has been withdrawn from dealers and distributors in Latvia at the beginning of 2014 and provided information claiming that harmonised standard EN 60335-2-77:2006 was correctly applied.

Latvia provided information indicating that its national measure was still in place. It also confirmed that this measure was based on the application of harmonised standard EN 60335-2-77:2010 and assessment under that harmonised standard only. The additional information provided by Latvia was not sufficient to demonstrate an incorrect application of harmonised standard EN 60335-2-77:2006.

In the light of all the information available, and noting, in particular, that the Latvian measure was based on the assessment of conformity with the harmonised standard EN 60335-2-77:2010, while it follows from the judgement of the General Court of 26 January 2017 that harmonised standard EN 60335-2-77:2006 applied to the product during the period concerned, the national measure cannot be considered justified,

HAS ADOPTED THIS DECISION:

Article 1

The measure taken by Latvia to prohibit the placing on the market of lawnmower of type Stiga Collector 35 EL (C 350, 297352654/S13) manufactured by GGP Italy SpA, via del Lavoro 6, 31033 Castelfranco Veneto, Italy, is not justified.

Article 2

This Decision is addressed to the Member States.
