DECISION OF THE EEA JOINT COMMITTEE

No 104/2017

of 13 June 2017

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2018/799]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Regulation (EU) 2015/45 of 14 January 2015 amending Directive 2007/46/EC of the European Parliament and of the Council and Commission Regulation (EC) No 692/2008 as regards innovative technologies for reducing CO2 emissions from light commercial vehicles (1) is to be incorporated into the EEA Agreement.

(2)

Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following indent is added in points 45zu (Commission Regulation (EC) No 692/2008) and 45zx (Directive 2007/46/EC of the European Parliament and of the Council) of Chapter I of Annex II to the EEA Agreement:

‘—

32015 R 0045: Commission Regulation (EU) 2015/45 of 14 January 2015 (OJ L 9, 15.1.2015, p. 1).’

Article 2

The text of Regulation (EU) 2015/45 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 14 June 2017, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1), or on the day of the entry into force of Decision of the EEA Joint Committee No 109/2017 of 16 June 2017 (2), or on the day of the entry into force of Decision of the EEA Joint Committee No 111/2017 of 16 June 2017 (3), whichever is the later.

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.

DECISION OF THE EEA JOINT COMMITTEE

No 105/2017

of 13 June 2017

amending Annex XI (Electronic communication, audiovisual services and information society) to the EEA Agreement [2018/800]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Regulation (EU) 2017/920 of the European Parliament and of the Council of 17 May 2017 amending Regulation (EU) No 531/2012 as regards rules for wholesale roaming markets (1) is to be incorporated into the EEA Agreement.

(2)

Commission Implementing Regulation (EU) 2016/2286 of 15 December 2016 laying down detailed rules on the application of fair use policy and on the methodology for assessing the sustainability of the abolition of retail roaming surcharges and on the application to be submitted by a roaming provider for the purposes of that assessment (2) is to be incorporated into the EEA Agreement.

(3)

Commission Implementing Regulation (EU) 2016/2292 of 16 December 2016 setting out the weighted average of maximum mobile termination rates across the Union and repealing Implementing Regulation (EU) 2015/2352 (3) is to be incorporated into the EEA Agreement.

(4)

Implementing Regulation (EU) 2016/2292 repeals Commission Implementing Regulation (EU) 2015/2352 (4), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

(5)

Annex XI to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex XI to the EEA Agreement shall be amended as follows:

(1)

the following indent is added in point 5cu (Regulation (EU) No 531/2012 of the European Parliament and of the Council):

‘—

32017 R 0920: Regulation (EU) 2017/920 of the European Parliament and of the Council of 17 May 2017 (OJ L 147, 9.6.2017, p. 1).’;

(2)

the following adaptation is added in point 5cu (Regulation (EU) No 531/2012 of the European Parliament and of the Council:

‘(c)

Provisions of the Regulation conferring tasks to BEREC shall apply in accordance with, and from the date of entry into force of, a decision of the EEA Joint Committee incorporating of Regulation (EC) No 1211/2009 of the European Parliament and of the Council into the EEA Agreement.’;

(3)

the following point is inserted after point 5cub (Commission Implementing Regulation (EU) 2015/2352):

‘5cuc.

The texts of Regulation (EU) 2017/920 and Implementing Regulations (EU) 2016/2286 and (EU) 2016/2292 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 14 June 2017, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 4

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Regulation (EU) 2016/403 of 18 March 2016 supplementing Regulation (EC) No 1071/2009 of the European Parliament and of the Council with regard to the classification of serious infringements of the Union rules, which may lead to the loss of good repute by the road transport operator, and amending Annex III to Directive 2006/22/EC of the European Parliament and of the Council (1) is to be incorporated into the EEA Agreement.

(2)

Annex XIII to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex XIII to the EEA Agreement shall be amended as follows:

(1)

the following point is inserted after point 19ab (Commission Regulation (EU) No 1213/2010):

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Decision (EU) 2017/175 of 25 January 2017 on establishing EU Ecolabel criteria for tourist accommodation (1) is to be incorporated into the EEA Agreement.

(2)

Commission Decision (EU) 2017/176 of 25 January 2017 on establishing EU Ecolabel criteria for wood-, cork- and bamboo-based floor coverings (2) is to be incorporated into the EEA Agreement.

(3)

Decision (EU) 2017/175 repeals Commission Decisions 2009/564/EC (3) and 2009/578/EC (4), which are incorporated into the EEA Agreement and are consequently to be repealed under the EEA Agreement.

(4)

Decision (EU) 2017/176 repeals Commission Decision 2010/18/EC (5), which is incorporated into the EEA Agreement and is consequently to be repealed under the EEA Agreement.

(5)

Annex XX to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Annex XX to the EEA Agreement shall be amended as follows:

The text of point 2m (Commission Decision 2009/578/EC) is replaced by the following:

32017 D 0175: Commission Decision (EU) 2017/175 of 25 January 2017 on establishing EU Ecolabel criteria for tourist accommodation (OJ L 28, 2.2.2017, p. 9).’

2.

The text of point 2zb (Commission Decision 2010/18/EC) is replaced by the following:

DECISION OF THE EEA JOINT COMMITTEE

No 115/2017

of 13 June 2017

amending Protocol 3 to the EEA Agreement, concerning products referred to in Article 8(3)(b) of the Agreement [2018/808]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Protocol 3 to the EEA Agreement determines specific trade arrangements for certain agricultural and processed agricultural products between the Contracting Parties.

(2)

Article 2(2) of Protocol 3 to the EEA Agreement stipulates that the customs duties set out in the Annexes to Table I of Protocol 3 to the EEA Agreement can be adapted by the EEA Joint Committee taking account of mutual concessions. Iceland and the European Union have agreed to eliminate tariffs for certain products listed in Protocol 3 to the EEA Agreement. These concessions will apply only to products originating in the European Union and in Iceland, respectively, within the meaning of the Regional Convention on pan-Euro-Mediterranean preferential rules of origin.

(3)

Protocol 3 to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Protocol 3 to the EEA Agreement shall be amended as follows:

(1)

in Article 2, the following subparagraph is added at the end of paragraph 1:

‘Products covered by Table I originating in Iceland or the European Union in accordance with the provisions of the Regional Convention on pan-Euro-Mediterranean preferential rules of origin shall be subject to the customs duties set out in point 4a of Annex I to Table I and point 1a of Annex II to Table I, respectively.’;

Article 2

This Decision shall enter into force on 14 June 2017, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1), or on the same day as the entry into force of the Agreement in the form of an Exchange of Letters between the European Union and Iceland concerning additional trade preferences in agricultural products (1), whichever is the later.

Article 3

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
