COUNCIL IMPLEMENTING REGULATION (EU) 2023/180

of 27 January 2023

implementing Regulation (EU) 2022/2474 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union and in particular Article 29 thereof,

Having regard to Council Regulation (EU) 2022/2474 of 16 December 2022 amending Regulation (EU) No 833/2014 concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine (1), and in particular Article 1(19) thereof,

Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

On 16 December 2022, the Council adopted Regulation (EU) 2022/2474, which amended Council Regulation (EU) No 833/2014 (2) and introduced further restrictive measures to suspend the broadcasting activities in the Union, or directed at the Union, of certain media outlets referred to in Annex V to Regulation (EU) 2022/2474. Pursuant to Article 1, point (19), of Regulation (EU) 2022/2474, the applicability of such measures in respect of one or several of those media outlets is subject to the adoption of implementing acts by the Council.

(2)

Having examined the respective cases, the Council has concluded that the restrictive measures referred to in Article 2f of Regulation (EU) No 833/2014 should apply from 1 February 2023 in respect of all entities referred to in Annex V to Regulation (EU) 2022/2474,

HAS ADOPTED THIS REGULATION:

Article 1

The measures referred to in Article 2f of Regulation (EU) No 833/2014 shall apply from 1 February 2023 in respect of all entities referred to in Annex V to Regulation (EU) 2022/2474.

Article 2

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Whereas:

The Bulgarian, Czech, French, Greek, Hungarian, Latvian, Maltese and Slovenian language versions of Commission Delegated Regulation (EU) 2016/1149 (3) contain errors in Article 53(2), first subparagraph, as regards minor changes to beneficiaries’ operations and the eligibility of any part of the operation and its overall objectives.

(2)

The Bulgarian, Czech, French, Greek, Hungarian, Latvian, Maltese and Slovenian language versions of Delegated Regulation (EU) 2016/1149 should therefore be corrected accordingly. The other language versions are not affected,

HAS ADOPTED THIS REGULATION:

Article 1

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION DELEGATED REGULATION (EU) 2023/183

of 23 November 2022

amending Regulation (EU) 2019/6 of the European Parliament and of the Council as regards the requirements on compliance with good laboratory practice for veterinary medicinal products set out in Annex II to that Regulation

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) 2019/6 of the European Parliament and of the Council of 11 December 2018 on veterinary medicinal products and repealing Directive 2001/82/EC (1), and in particular Article 146(1) thereof,

Whereas:

Certain references to requirements for pre-clinical studies set out in Annex II to Regulation (EU) 2019/6 need to be adapted to reflect the fact that compliance with good laboratory practice is not required in relation to efficacy studies, but only for safety studies. Point I.1.6, point I.2.3.(1)(b), point I.2.4.(2)(b), point IIIb.3A(2) and point IIIb.4B.(4)(b) of Annex II to Regulation (EU) 2019/6 should be adapted accordingly, thus ensuring that the provisions on compliance with good laboratory practice are applied correctly. The European Medicines Agency has been consulted.

(2)

Regulation (EU) 2019/6 should therefore be amended accordingly.

(3)

Since Annex II to Regulation (EU) 2019/6, as replaced by Commission Delegated Regulation (EU) 2021/805 (2) has applied since 28 January 2022, this Regulation should also apply from that date in order to avoid unnecessary repetition of pharmacological, toxicological, residue and pre-clinical safety studies conducted with respect to applications for marketing authorisations submitted before the entry into force of this Regulation.

HAS ADOPTED THIS REGULATION:

Article 1

Annex II to Regulation (EU) 2019/6 is amended in accordance with the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

It shall apply from 28 January 2022.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

Annex II to Regulation (EU) 2019/6 is amended as follows:

point I.1.6 is replaced by the following:

‘Pharmacological, toxicological, residue and pre-clinical safety studies shall be carried out in conformity with the provisions related to Good Laboratory Practice (GLP) laid down in Directives 2004/10/EC (*) and 2004/9/EC (**) of the European Parliament and of the Council;

(*)  Directive 2004/10/EC of the European Parliament and of the Council of 11 February 2004 on the harmonisation of laws, regulations and administrative provisions relating to the application of the principles of good laboratory practice and the verification of their applications for tests on chemical substances (OJ L 50, 20.2.2004, p. 44)."

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) No 1151/2012 of the European Parliament and of the Council of 21 November 2012 on quality schemes for agricultural products and foodstuffs (1), and in particular Article 52(2) thereof,

Whereas:

Pursuant to Article 50(2)(a) of Regulation (EU) No 1151/2012, Italy’s application to register the name ‘Ciliegia di Bracigliano’ was published in the Official Journal of the European Union (2).

(2)

As no statement of opposition under Article 51 of Regulation (EU) No 1151/2012 has been received by the Commission, the name ‘Ciliegia di Bracigliano’ should therefore be entered in the register,

HAS ADOPTED THIS REGULATION:

Article 1

The name ‘Ciliegia di Bracigliano’ (PGI) is hereby entered in the register.

The name specified in the first paragraph denotes a product in Class 1.6. Fruit, vegetables and cereals, fresh or processed, as listed in Annex XI to Commission Implementing Regulation (EU) No 668/2014 (3).

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION IMPLEMENTING REGULATION (EU) 2023/185

of 27 January 2023

initiating a ‘new exporter’ review of Implementing Regulation (EU) 2021/607 imposing a definitive anti-dumping duty on imports of citric acid originating in the People’s Republic of China for one Chinese exporting producer, repealing the duty with regard to imports from that exporting producer and making these imports subject to registration

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) 2016/1036 of the European Parliament and of the Council of 8 June 2016 on protection against dumped imports from countries not members of the European Union (1) (‘the basic Regulation’) and in particular Articles 11(4) and 14(5) thereof,

After having informed the Member States,

Whereas:

1.   REQUEST

(1)

On 17 May 2022, the Commission received a request for a ‘new exporter’ review under Article 11(4) of the basic Regulation.

(2)

The request was lodged by Seven Star Lemon Technology co., Ltd. (‘the applicant’), an exporting producer of citric acid in the People’s Republic of China (‘the PRC’).

2.   PRODUCT UNDER REVIEW

(3)

The product under review is citric acid and trisodium citrate dihydrate, currently falling under CN codes 2918 14 00 and ex 2918 15 00 (TARIC codes 2918150011 and 2918150019) and originating in the PRC.

3.   EXISTING MEASURES

The measures currently in force are a definitive anti-dumping duty imposed by Commission Implementing Regulation (EU) 2021/607 (2) under which imports of the product under review originating in the PRC, including the product produced by the applicant, are subject to a definitive anti-dumping duty of 42,7 % with the exception of several companies specifically mentioned in Article 1(2) of that Regulation which are subject to individual duty rates.

4.   GROUNDS FOR THE REVIEW

The applicant provided sufficient evidence that it did not export the product under review to the Union during the investigation period on which the anti-dumping measures were based (1 July 2006 to 30 June 2007).

The applicant provided sufficient evidence that it is not related to any of the exporting producers of the product under review which are subject to the anti-dumping duties in force.

(7)

Finally, the applicant provided sufficient evidence that it has begun exporting the product under review to the Union after the end of the original investigation period, namely from June 2021.

5.   PROCEDURE

5.1.   Initiation

The Commission examined the evidence available and concluded that there was sufficient evidence to justify the initiation of a ‘new exporter’ review pursuant to Article 11(4) of the basic Regulation, with a view to determining the applicant’s individual margin of dumping. Should dumping be found, the Commission will determine the level of the duty to which the imports of the product under review produced by the applicant should be subject.

In accordance with Article 11(4), the normal value for the applicant shall be determined following the methodology laid down in Article 2(1) to (6a) of the basic Regulation, as the latest expiry review of the measures was initiated after 20 December 2017.

Union producers known to be concerned were informed of the request for a review on 28 November 2022 and were given an opportunity to comment until 12 December 2022.

(11)

The Commission also draws the attention of the parties that further to the COVID-19 outbreak a Notice (3) has been published on the consequences of the COVID-19 outbreak on anti-dumping and anti-subsidy investigations that may be applicable to this proceeding.

5.2.   Repeal of the existing measures and registration of imports

Pursuant to Article 11(4) of the basic Regulation, the anti-dumping duty in force should be repealed with regard to imports of the product under review produced by the applicant. At the same time, such imports should be made subject to registration in accordance with Article 14(5) of the basic Regulation, in order to ensure that anti-dumping duties can be levied from the date of the registration of these imports should the review result in a finding of dumping in respect of the applicant. Furthermore, the Commission notes that it is not possible, at this stage, to provide a reliable estimate of the amount of possible future liability, without prejudice to Article 9(4) of the basic Regulation. Should the request be withdrawn and the review terminated, the amount of the liability for the registered imports will be based on to the anti-dumping duty rate established by Regulation (EU) 2021/607 for ‘all other companies’, namely 42,7 %.

5.3.   Review investigation period

The investigation will cover the period from 1 January 2022 to 31 December 2022 (‘review investigation period’). However, the Commission reserves the right to also examine if transactions may have occurred in a subsequent period, and may amend the review investigation period as appropriate in light of the findings of the investigation.

5.4.   Investigating the applicant

In order to obtain information it deems necessary for its investigation, the Commission has made a questionnaire for the applicant available in the file for inspection by interested parties and on the website of the Directorate-General for Trade https://tron.trade.ec.europa.eu/investigations/case-view?caseId=2652. The applicant must submit the completed questionnaire within the time limit specified in Article 4(2) of this Regulation.

5.5.   Other written submissions

Subject to the provisions of this Regulation, all interested parties are invited to make their views known, submit information and provide supporting evidence. Unless otherwise specified, this information and supporting evidence must reach the Commission within the time-limit specified in Article 4(2) of this Regulation.

5.6.   Possibility to be heard by the Commission investigation services

All interested parties may request to be heard by the Commission investigation services within the time-limits specified in Article 4(3) of this Regulation. Any request to be heard must be made in writing and must specify the reasons for the request. For hearings on issues pertaining to the initiation stage of the investigation the request must be submitted within 15 days of the date of entry into force of this Regulation. Thereafter, a request to be heard must be submitted within the specific deadlines set by the Commission in its communication with the parties.

5.7.   Instructions for making written submissions and sending completed questionnaires and correspondence

Information submitted to the Commission for the purpose of trade defence investigations shall be free from copyrights. Parties, before submitting to the Commission information and/or data which is subject to third party copyrights, must request specific permission to the copyright holder explicitly allowing a) the Commission to use the information and data for the purpose of this trade defence proceeding and b) to provide the information and/or data to interested parties to this investigation in a form that allows them to exercise their rights of defence.

All written submissions, including the information requested in this Regulation, completed questionnaires and correspondence provided by interested parties for which confidential treatment is requested shall be labelled ‘Sensitive’ (4). Interested parties submitting information in the course of this investigation are invited to reason their request for confidential treatment.

(19)

Parties providing ‘Sensitive’ information are required to furnish non-confidential summaries of it pursuant to Article 19(2) of the basic Regulation, which will be labelled ‘For inspection by interested parties’. Those summaries should be sufficiently detailed to permit a reasonable understanding of the substance of the information submitted in confidence.

(20)

If a party providing confidential information fails to show good cause for a confidential treatment request or does not furnish a non-confidential summary of it in the requested format and quality, the Commission may disregard such information unless it can be satisfactorily demonstrated from appropriate sources that the information is correct.

(21)

Interested parties are invited to make all submissions and requests via TRON.tdi (https://webgate.ec.europa.eu/tron/TDI) including scanned powers of attorney and certification sheets.

6.   NON-COOPERATION

If any interested party refuses access to or does not provide the necessary information within the time limits, or significantly impedes the investigation, findings, affirmative or negative, may be made on the basis of facts available, in accordance with Article 18 of the basic Regulation.

(26)

Where it is found that any interested party has supplied false or misleading information, the information shall be disregarded and use may be made of facts available in accordance with Article 18 of the basic Regulation.

(27)

If an interested party does not cooperate or cooperates only partially and findings are therefore based on facts available in accordance with Article 18 of the basic Regulation, the result may be less favourable to that party than if it had cooperated.

7.   HEARING OFFICER

(28)

Interested parties may request the intervention of the Hearing Officer for trade proceedings. The Hearing Officer reviews requests for access to the file, disputes regarding the confidentiality of documents, requests for extension of time limits and any other request concerning the rights of defence of interested parties and third parties as may arise during the proceeding.

(29)

The Hearing Officer may organise hearings and mediate between the interested party/-ies and Commissions services to ensure that the interested parties’ rights of defence are being fully exercised. A request for a hearing with the Hearing Officer should be made in writing and should specify the reasons for the request. The Hearing Officer will examine the reasons for the requests. These hearings should only take place if the issues have not been settled with the Commission services in the due course.

Any request must be submitted in good time and expeditiously so as not to jeopardise the orderly conduct of proceedings. To that effect, interested parties should request the intervention of the Hearing Officer at the earliest possible time following the occurrence of the event justifying such intervention. Where hearing requests are submitted outside the relevant timeframes, the Hearing Officer will also examine the reasons for such late requests, the nature of the issues raised and the impact of those issues on the rights of defence, having due regard to the interests of good administration and the timely completion of the investigation.

HAS ADOPTED THIS REGULATION:

Article 1

A review of Implementing Regulation (EU) 2021/607 is hereby initiated under Article 11(4) of Regulation (EU) 2016/1036 in order to determine if an individual anti-dumping duty should be imposed on the imports of citric acid and trisodium citrate dihydrate, currently falling under CN codes 2918 14 00 and ex 2918 15 00 (TARIC codes 2918150011 and 2918150019), originating in the People’s Republic of China, produced for export to the Union by Seven Star Lemon Technology co., Ltd. (TARIC additional code A023).

Article 2

The anti-dumping duty imposed by Implementing Regulation (EU) 2021/607 is hereby repealed with regard to the imports identified in Article 1 of this Regulation.

Article 3

The national customs authorities shall take the appropriate steps to register the imports identified in Article 1 of this Regulation, pursuant to Articles 11(4) and 14(5) of Regulation (EU) 2016/1036.

Registration shall expire 9 months following the date of entry into force of this Regulation.

Article 4

1.   Interested parties must make themselves known by contacting the Commission within 15 days from the date of entry into force of this Regulation.

2.   Interested parties, if their representations are to be taken into account during the investigation, must present their views in writing and submit questionnaire replies or any other information within 37 days from the date of the publication of this Regulation in the Official Journal of the European Union, unless otherwise specified.

3.   Interested parties may also apply to be heard by the Commission within the same 37-day time limit. For hearings on issues pertaining to the initiation stage of the investigation the request must be submitted within 15 days of the date of entry into force of this Regulation. Any request to be heard must be made in writing and must specify the reasons for the request.

Article 5

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION IMPLEMENTING REGULATION (EU) 2023/186

amending Implementing Regulation (EU) 2021/2325 as regards the recognition of certain control authorities and control bodies for the purpose of importing organic products into the Union

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EU) 2018/848 of the European Parliament and of the Council of 30 May 2018 on organic production and labelling of organic products and repealing Council Regulation (EC) No 834/2007 (1), and in particular Article 57(2) thereof,

Whereas:

(1)

Annex II to Commission Implementing Regulation (EU) 2021/2325 (2) sets out the list of control authorities and control bodies recognised for the purpose of equivalence and competent to carry out controls and issue certificates in third countries. In the light of new information and requests received by the Commission since the adoption of Implementing Regulation (EU) 2021/2325, certain changes should be made to that list.

(2)

The Commission has received and examined a request from ‘Certificadora Mexicana de productos y procesos ecológicos S.C.’ to withdraw its recognition for product category A for the Dominican Republic, Guatemala and El Salvador due to the lack of operators.

(3)

The Commission has received and examined a request from ‘EKO-CONTROL SK s.r.o.’ to withdraw its recognition for all third countries for which it is recognised.

(4)

‘LETIS S.A.’ failed to provide in its annual report and following subsequent requests updated information on the assessment report issued by its accreditation body according to Article 33(3) of Council Regulation (EC) No 834/2007 (3) concerning unprocessed aquaculture products and algae for which it is recognised.

(5)

Furthermore, ‘LETIS S.A.’ did not communicate to the Commission all information related to its technical dossier.

(6)

‘LETIS S.A.’ has also failed to take adequate corrective measures in response to instances of non-compliance with, and infringements of, the organic production rules observed by the Commission. The non-compliance and infringements observed include: (i) the existence of several OFIS notifications involving that control body; and (ii) inadequate follow-up investigations by ‘LETIS S.A.’ of those OFIS notifications.

(7)

Finally, following the audit of ‘LETIS S.A.’ carried out by the Commission in 2021, ‘LETIS S.A’ failed to demonstrate that it implemented effective and reinforced control measures and took the necessary corrective actions to remedy the shortcomings identified by the Commission. This creates a risk for the consumer to be misled about the true nature of the products certified by ‘LETIS S.A.’.

For each of the four reasons set out in recitals 4-7 above, and in accordance with Article 4(1) point (d)(ii), (iii), (v) and (vii), of Commission Delegated Regulation (EU) 2021/1342 (4), ‘LETIS S.A.’ should be withdrawn from the list of control authorities and control bodies set out in Annex II to Implementing Regulation (EU) 2021/2325.

(9)

Implementing Regulation (EU) 2021/2325 should therefore be amended accordingly.

(10)

The measures provided for in this Regulation are in accordance with the opinion of the Organic Production Committee,

HAS ADOPTED THIS REGULATION:

Article 1

Annex II to Regulation (EU) 2021/2325 is amended in accordance with the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

on the position to be adopted on behalf of the European Union within the Sanitary and Phytosanitary Sub-Committee established by the Association Agreement between the European Union and the European Atomic Energy Community and their Member States, of the one part, and Georgia, of the other part, as regards the modification of Annex XI-B to that Agreement

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 207(4), first paragraph, in conjunction with Article 218(9) thereof,

Having regard to the proposal from the European Commission,

Whereas:

(1)

The Association Agreement between the European Union and the European Atomic Energy Community and their Member States, of the one part, and Georgia, of the other part (1) (‘the Agreement’) entered into force on 1 July 2016.

(2)

Article 65 of the Agreement established the Sanitary and Phytosanitary Sub-Committee (the ‘SPS Sub-Committee’), which is to consider any matter relating to Chapter 4 (Sanitary and phytosanitary measures) of Title IV (Trade and Trade-related Matters) of the Agreement, including its implementation, and is empowered to review and modify Annex XI-B to the Agreement.

(3)

The SPS Sub-Committee is to adopt a decision modifying Annex XI-B to the Agreement, which contains an approximation list of sanitary and phytosanitary, animal welfare and other Union legislative measures to which Georgia is to gradually approximate its sanitary and phytosanitary, animal welfare and other legislative measures pursuant to Article 55(1) of the Agreement.

The SPS Sub-Committee finalised the approximation list set out in Annex XI-B to the Agreement by means of Decision No 1/2017 of the EU-Georgia Sanitary and Phytosanitary Sub-Committee (2).

(5)

At seven annual meetings of the SPS Sub-Committee, Georgia informed the Commission on the progress made regarding the approximation of its legislation to the Union acquis. Georgia also informed the Commission of Union legal acts that should be removed from Annex XI-B on the consideration that those Union legal acts are not relevant for Georgia as they are only applicable to Member States.

(6)

Since the adoption of Decision No 1/2017, several Union legal acts listed in Annex XI-B to the Agreement have been repealed and some of those repealed Union legal acts have been replaced by new Union legal acts, while other Union legal acts have exhausted their legal effect.

(7)

It is thus necessary to modify Annex XI-B to the Agreement in order to reflect the evolution of the Union acquis listed in that Annex and to replace it.

(8)

It is therefore appropriate to establish the position to be adopted on the Union’s behalf within the SPS Sub-Committee with regard to the modification of Annex XI-B to the Agreement,

HAS ADOPTED THIS DECISION:

Article 1

The position to be adopted on the Union’s behalf within the Sanitary and Phytosanitary Sub-Committee (the ‘SPS Sub Committee’) established by Article 65 of the Association Agreement between the European Union and the European Atomic Energy Community and their Member States, of the one part, and Georgia, of the other part, as regards the modification of Annex XI-B to the Agreement, shall be based on the draft Decision of the SPS Sub-Committee attached to this Decision.

Minor technical changes to the draft Decision of the SPS Sub-Committee attached to this Decision, which do not jeopardise the attainment of the objective of those modifications of Annex XI-B to the Agreement, may be agreed by the representatives of the Union within the SPS Sub-Committee without further decision of the Council.

Article 2

This Decision shall enter into force on the date of its adoption.

THE EU-GEORGIA SANITARY AND PHYTOSANITARY SUB-COMMITTEE,

Having regard to the Association Agreement between the European Union and the European Atomic Energy Community and their Member States, of the one part, and Georgia, of the other part, and in particular Articles 55 and 65 thereof,

Whereas:

(1)

The Association Agreement between the European Union and the European Atomic Energy Community and their Member States, of the one part, and Georgia, of the other part (1) (‘the Agreement’) entered into force on 1 July 2016.

(2)

Pursuant to Article 55(1) of the Agreement, Georgia is to gradually approximate its sanitary and phytosanitary, animal welfare and other legislative measures to those of the Union as set out in Annex XI-B to the Agreement.

(3)

Article 65 of the Agreement established the Sanitary and Phytosanitary Sub-Committee (the ‘SPS Sub-Committee’), which is to consider any matter relating to Chapter 4 (Sanitary and phytosanitary measures) of Title IV (Trade and Trade-related Matters) of the Agreement, including its implementation, and is empowered to review and modify Annex XI-B to the Agreement.

Since the adoption of Decision No 1/2017 of the EU-Georgia Sanitary and Phytosanitary Sub-Committee (2), several Union legal acts listed in Annex XI-B to the Agreement have been repealed and some of those repealed Union legal acts have been replaced by new Union legal acts, while other Union legal acts have exhausted their legal effect. In addition, the Parties to the Agreement consider that a limited number of Union legal acts are not relevant for Georgia as they are only applicable to Member States.

It is thus necessary to modify Annex XI-B to the Agreement in order to reflect the evolution of the Union acquis listed in that Annex and to replace it. It is also appropriate to provide for a period during which Georgia is to approximate its legislation to the new Union legal acts. Accordingly, new deadlines for the approximation of Georgian legislation to the Union legal acts listed in Annex XI-B to the Agreement should be indicated therein.

It is appropriate for the SPS Sub-Committee to take a decision to modify Annex XI-B to the Agreement to include the list as set out in the Annex to this Decision,

HAS ADOPTED THIS DECISION:

Article 1

Annex XI-B to the Association Agreement between the European Union and the European Atomic Energy Community and their Member States, of the one part, and Georgia, of the other part, is hereby modified as set out in the Annex to this Decision and replaced by it.

Article 2

This Decision shall enter into force on the date of its adoption.

Pursuant to Article 300(3) of the Treaty, the Committee of the Regions is to consist of representatives of regional and local bodies who either hold a regional or local authority electoral mandate or are politically accountable to an elected assembly.

On 10 December 2019, the Council adopted Decision (EU) 2019/2157 (2), appointing the members and alternate members of the Committee of the Regions for the period from 26 January 2020 to 25 January 2025.

(3)

A member’s seat on the Committee of the Regions has become vacant following the end of the national mandate on the basis of which Mr Günther PLATTER was proposed for appointment.

(4)

The Austrian Government has proposed Mr Anton MATTLE, representative of a regional body who holds a regional authority electoral mandate, Landeshauptmann von Tirol (Governor of Tyrol), as a member of the Committee of the Regions for the remainder of the current term of office, which runs until 25 January 2025,

HAS ADOPTED THIS DECISION:

Article 1

Mr Anton MATTLE, representative of a regional body who holds an electoral mandate, Landeshauptmann von Tirol (Governor of Tyrol), is hereby appointed as a member of the Committee of the Regions for the remainder of the current term of office, which runs until 25 January 2025.

This Decision shall enter into force on the date of its adoption.

COUNCIL DECISION (CFSP) 2023/190

concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union and in particular Article 29 thereof,

Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

On 31 July 2014, the Council adopted Decision 2014/512/CFSP (1).

(2)

On 16 December 2022, the Council adopted Decision (CFSP) 2022/2478 (2), which amended Decision 2014/512/CFSP and introduced further restrictive measures to suspend the broadcasting activities in the Union, or directed at the Union, of certain media outlets referred to in point (2) of the Annex to Decision (CFSP) 2022/2478. Pursuant to the second paragraph of Article 1 of Decision (CFSP) 2022/2478, the applicability of such measures in respect of one or several of those media outlets is subject to a further decision by the Council.

(3)

Having examined the respective cases, the Council has concluded that the restrictive measures referred to in Article 4g of Decision 2014/512/CFSP should apply from 1 February 2023 in respect of all entities referred to in point (2) of the Annex to Decision (CFSP) 2022/2478,

HAS ADOPTED THIS DECISION:

Article 1

The measures referred to in Article 4g of Decision 2014/512/CFSP shall apply from 1 February 2023 in respect of all entities referred to in point (2) of the Annex to Decision (CFSP) 2022/2478.

Article 2

This Decision shall enter into force on the day following that of its publication in the Official Journal of the European Union.

COUNCIL DECISION (CFSP) 2023/191

amending Decision 2014/512/CFSP concerning restrictive measures in view of Russia’s actions destabilising the situation in Ukraine

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on European Union, and in particular Article 29 thereof,

Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

On 31 July 2014, the Council adopted Decision 2014/512/CFSP (1).

(2)

In its Resolution ES-11/1, adopted on 2 March 2022, the United Nations General Assembly deplored in the strongest terms the aggression by the Russian Federation against Ukraine in violation of Article 2(4) of the United Nations (UN) Charter. In its Resolution ES-11/4, adopted on 12 October 2022, the UN General Assembly, noting the UN Secretary-General’s statement of 29 September 2022 in which he recalled that any annexation of a State’s territory by another State resulting from the threat or use of force is a violation of the principles of the Charter and international law, condemned the organisation by the Russian Federation of illegal so-called referenda in regions within the internationally recognised borders of Ukraine and the attempted illegal annexation of the Donetsk, Kherson, Luhansk and Zaporizhzhia regions of Ukraine, following the organisation of those so-called referenda. In its binding order indicating provisional measures of 16 March 2022, the International Court of Justice ordered the Russian Federation to immediately suspend the military operations that it had commenced in the territory of Ukraine.

(3)

As long as the illegal actions by the Russian Federation continue to violate the prohibition on the use of force, which is a peremptory rule of international law, it is appropriate to maintain in force all the measures imposed by the Union and to take additional measures, if necessary. Consequently, Decision 2014/512/CFSP should be renewed for a further 6 months.

(4)

Decision 2014/512/CFSP should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

In Decision 2014/512/CFSP, Article 9(1) is replaced by the following:

‘1.   This Decision shall apply until 31 July 2023.’.

Article 2

This Decision shall enter into force on the day following that of its publication in the Official Journal of the European Union.
