DECISION (EU) 2023/136 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL

of 18 January 2023

amending Directive 2003/87/EC as regards the notification of offsetting in respect of a global market-based measure for aircraft operators based in the Union

THE EUROPEAN PARLIAMENT AND THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union, and in particular Article 192(1) thereof,

Having regard to the proposal from the European Commission,

After transmission of the draft legislative act to the national parliaments,

Having regard to the opinion of the European Economic and Social Committee (1),

Having regard to the opinion of the Committee of the Regions (2),

Acting in accordance with the ordinary legislative procedure (3),

Whereas:

(1)

The Carbon Offsetting and Reduction Scheme for International Aviation (CORSIA) of the International Civil Aviation Organization (ICAO) has been in operation since 2019 as regards the monitoring, reporting and verification of emissions, and is intended to be a globally applied market-based measure aiming to offset international aviation carbon dioxide emissions from 1 January 2021 above a fixed emissions level with certain offset credits.

The Paris Agreement, adopted in December 2015 under the United Nations Framework Convention on Climate Change (UNFCCC) (4), entered into force in November 2016. Its Parties have agreed to hold the increase in the global average temperature well below 2 °C above pre-industrial levels and to pursue efforts to limit the temperature increase to 1,5 °C above pre-industrial levels. That commitment has been reinforced with the adoption of the Glasgow Climate Pact in November 2021, in which the Conference of the Parties recognised that the impacts of climate change would be much lower at a temperature increase of 1,5 °C, compared with 2 °C, and resolved to pursue efforts to limit the temperature increase to 1,5 °C.

Subject to the differences between Union legislation and the provisions in the First Edition of Annex 16, Volume IV, to the Convention on International Civil Aviation – Carbon Offsetting and Reduction Scheme for International Aviation, establishing the International Standards and Recommended Practices on Environmental Protection for CORSIA (CORSIA SARPs), and which were notified to ICAO following the adoption of Council Decision (EU) 2018/2027 (5), and subject to the manner in which the European Parliament and the Council amend Union legislation, the Union intends to implement CORSIA through Directive 2003/87/EC of the European Parliament and of the Council (6).

Commission Delegated Regulation (EU) 2019/1603 (7) was adopted in order to appropriately implement the rules of CORSIA for monitoring, reporting and verification of aviation emissions. The offsetting within the meaning of the CORSIA SARPs is calculated on the basis of CO2 emissions verified in accordance with that Delegated Regulation.

Due to a large decrease in aviation emissions in 2020 as a consequence of the COVID-19 pandemic, the ICAO Council decided in its 220th session in June 2020 that 2019 emissions should be used as baseline for calculating the offsetting to be carried out by aircraft operators for the years 2021 to 2023. That decision was endorsed by the ICAO 41st Assembly in October 2022.

Aviation emissions did not exceed their collective 2019 levels in 2021. On 31 October 2022, ICAO determined that the Sector Growth Factor (SGF) for 2021 emissions equals zero. The SGF is a parameter of the CORSIA methodology used to calculate operators’ annual offsetting requirements. Therefore, aircraft operators’ additional offsetting is to be zero for the year 2021.

Member States should implement CORSIA by notifying aircraft operators that hold an air operator certificate issued by a Member State and aircraft operators that are registered in a Member State of those aircraft operators’ offsetting in respect of the year 2021 by 30 November 2022.

Since the objectives of this Decision cannot be sufficiently achieved by the Member States but can rather, by reason of its scale and effects, be better achieved at Union level, the Union may adopt measures, in accordance with the principle of subsidiarity as set out in Article 5 of the Treaty on European Union. In accordance with the principle of proportionality as set out in that Article, this Decision does not go beyond what is necessary in order to achieve those objectives.

It is important to ensure there is legal certainty for national authorities and for aircraft operators as regards CORSIA offsetting for the year 2021, as soon as possible in 2022. Accordingly, this Decision should enter into force without delay.

Without prejudice to the adoption of a Directive of the European Parliament and of the Council amending Directive 2003/87/EC as regards the contribution of aviation to the Union’s economy-wide emissions reduction target, and appropriately implementing a global market-based measure, this Decision is intended to be a purely temporary measure that is only to apply pending the expiration of the transposition period of that Directive. In the event that the transposition period has not expired by 30 November 2023 and ICAO determines that the SGF for 2022 emissions equals zero, Member States should notify aircraft operators that their offsetting requirements in respect of the year 2022 amount to zero. If the SGF for 2022 emissions is different from zero, the Commission should be able, where appropriate, to submit a new proposal for the calculation and the notification of those offsetting requirements.

Directive 2003/87/EC should therefore be amended accordingly,

HAVE ADOPTED THIS DECISION:

Article 1

In Article 12 of Directive 2003/87/EC, the following paragraphs are added:

‘6.   By 30 November 2022, Member States shall notify aircraft operators that, in respect of the year 2021, their offsetting requirements within the meaning of paragraph 3.2.1 of ICAO’s International Standards and Recommended Practices on Environmental Protection for Carbon Offsetting and Reduction Scheme for International Aviation (CORSIA SARPs) amount to zero. Member States shall notify aircraft operators that fulfil the following conditions:

(a)

the aircraft operators hold an air operator certificate issued by a Member State or are registered in a Member State, including in the outermost regions, dependencies and territories of that Member State; and

(b)

they produce annual CO2 emissions greater than 10 000 tonnes from the use of aeroplanes with a maximum certified take-off mass greater than 5 700 kg conducting flights covered by Annex I to this Directive and by Article 2(3) of Commission Delegated Regulation (EU) 2019/1603 (*1), other than those departing and arriving in the same Member State, including the outermost regions of that Member State, from 1 January 2021.

For the purposes of the first subparagraph, point (b), CO2 emissions from the following types of flights shall not be taken into account:

(i)

state flights;

(ii)

humanitarian flights;

(iii)

medical flights;

(iv)

military flights;

(v)

firefighting flights;

(vi)

flights preceding or following a humanitarian, medical or firefighting flight, provided that such flights were conducted with the same aircraft and were required to accomplish the related humanitarian, medical or firefighting activities or to reposition the aircraft after those activities for its next activity.

7.   Pending a legislative act amending this Directive as regards the contribution of aviation to the Union’s economy-wide emission reduction target and appropriately implementing a global market-based measure, and in the event that the period for the transposition of such a legislative act has not expired by 30 November 2023, and the Sector Growth Factor (SGF) for 2022 emissions, to be published by ICAO, equals zero, Member States shall, by 30 November 2023, notify aircraft operators that, in respect of the year 2022, their offsetting requirements within the meaning of paragraph 3.2.1 of ICAO’s CORSIA SARPs amount to zero.

Article 2

This Decision shall enter into force on the day following that of its publication in the Official Journal of the European Union.

COMMISSION DELEGATED REGULATION (EU) 2023/137

amending Regulation (EC) No 1893/2006 of the European Parliament and of the Council establishing the statistical classification of economic activities NACE Revision 2

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Regulation (EC) No 1893/2006 of the European Parliament and of the Council of 20 December 2006 establishing the statistical classification of economic activities NACE Revision 2 and amending Council Regulation (EEC) No 3037/90 as well as certain EC Regulations on specific statistical domains (1), and in particular Article 6(2) thereof,

Whereas:

(1)

In order to function, the internal market requires statistical standards applicable to the collection, transmission and publication of national and Union statistics so that businesses, financial institutions, governments and all other operators in the internal market can have access to reliable and comparable statistical data. To this end, it is vital that the various categories for classifying activities in the Union be interpreted uniformly in all the Member States.

(2)

Reliable and comparable statistics are necessary to enable businesses to assess their competitiveness, and are useful to the Union institutions in preventing distortions of competition.

(3)

Regulation (EC) No 1893/2006 established a common statistical classification of economic activities in the European Community (hereinafter referred to as ‘NACE Rev. 2’), to meet the requirements of statistics at the time of its adoption, and for as long as it remained in line with the technological environment and the structure of the economy, as well as with the relevant international economic and social classifications.

(4)

Regulation (EC) No 1893/2006 empowers the Commission to adopt delegated acts, amending Annex I, to take account of technological or economic developments or to align it with other economic and social classifications.

(5)

Since the entry into force of NACE Rev. 2 on 1 January 2008, globalisation and digitalisation have changed the way in which many economic activities provide goods and services. New activities have gained in importance while others have lost importance in the global economy. Rapid changes have also taken place in the information-technology environment. In addition, the increased awareness of the impact of the economy on the environment has created specialised activities to protect the environment.

The international comparability of economic statistics requires that the Member States and the Union institutions use classifications of economic activities that are directly linked to the International Standard Industrial Classification of all Economic Activities (ISIC).

(7)

Following the adoption by the Statistical Commission of the United Nations of Revision 5 of the International Standard Industrial Classification of All Economic Activities (‘ISIC Rev. 5’), the NACE classification should be adapted in order to maintain its comparability and consistency with the standards for classifying economic activities used at international level.

(8)

By taking new economic activities rendered possible by recent structural, scientific and technological developments into account, the NACE classification should more closely reflect the reality of current economic activities in the Union.

(9)

An up-to-date NACE classification is central to the Commission’s ongoing efforts to modernise the production of Union statistics. This up-to-date classification is expected to contribute, through more comparable and relevant data, to better economic governance at both Union and national level.

(10)

Regulation (EC) No 1893/2006 should therefore be amended accordingly,

HAS ADOPTED THIS REGULATION:

Article 1

Annex I to Regulation (EC) No 1893/2006 is replaced by the Annex to this Regulation.

Article 2

1.   This Regulation shall apply to the data transmissions to the Commission (Eurostat) relating to each reference period from 1 January 2025.

2.   By way of derogation from paragraph 1, this Regulation shall apply to the data transmissions from the following dates:

(a)

for Council Regulation (EC) No 530/1999 (2), as regards:

statistics on the structure and distribution of earnings, it shall apply to the data transmissions relating to each reference period from 1 January 2026,

statistics on the level and composition of labour costs, it shall apply to the data transmissions relating to each reference period from 1 January 2028;

(b)

for Regulation (EC) No 2150/2002 of the European Parliament and of the Council (3), it shall apply to the data transmissions relating to each reference period from 1 January 2026;

(c)

for Regulation (EC) No 450/2003 of the European Parliament and of the Council (4), it shall apply to the data transmissions relating to each reference period from 1 January 2027;

(d)

for Regulation (EC) No 138/2004 of the European Parliament and of the Council (5), it shall apply to the data transmissions relating to each reference period from 1 January 2028;

(e)

for Regulation (EC) No 1552/2005 of the European Parliament and of the Council (6), it shall apply to the data transmissions relating to each reference period from 1 January 2030;

(f)

for Regulation (EC) No 453/2008 of the European Parliament and of the Council (7), it shall apply to the data transmissions relating to each reference period from 1 January 2026;

(g)

for Regulation (EC) No 1099/2008 of the European Parliament and of the Council (8), it shall apply to the data transmissions relating to each reference period from 1 January 2027;

(h)

for Regulation (EC) No 1338/2008 of the European Parliament and of the Council (9), as regards:

ANNEX II – Domain: Healthcare, subject: ‘healthcare expenditure and financing’, it shall apply to the data transmissions relating to each reference period from 1 January 2027,

ANNEX IV – Domain: Accidents at work, it shall apply to the data transmissions relating to each reference period from 1 January 2027;

for Regulation (EU) No 691/2011 of the European Parliament and of the Council (10), as regards:

Annex I – MODULE FOR AIR EMISSIONS ACCOUNTS, it shall apply to the data transmissions relating to each reference period from 1 January 2028,

Annex II – MODULE FOR ENVIRONMENTALLY RELATED TAXES BY ECONOMIC ACTIVITY, it shall apply to the data transmissions relating to each reference period from 1 January 2028,

Annex VI – MODULE FOR PHYSICAL ENERGY FLOW ACCOUNTS, it shall apply to the data transmissions relating to each reference period from 1 January 2028;

(j)

for Regulation (EU) No 70/2012 of the European Parliament and of the Council (11), it shall apply to the data transmissions relating to each reference period from 1 January 2026;

(k)

for Regulation (EU) No 549/2013 of the European Parliament and of the Council (12), as regards Annex B, it shall apply to data transmissions from September 2029;

(l)

for Regulation (EU) 2019/1700 of the European Parliament and of the Council (13), as regards:

the ‘labour force’ and ‘income and living conditions’ domains, it shall apply to the data transmissions relating to each reference period from 1 January 2026,

Article 3

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

COMMISSION IMPLEMENTING REGULATION (EU) 2023/138

of 21 December 2022

laying down a list of specific high-value datasets and the arrangements for their publication and re-use

THE EUROPEAN COMMISSION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Directive (EU) 2019/1024 of the European Parliament and of the Council of 20 June 2019 on open data and the re-use of public sector information (1), and in particular Article 14(1) thereof,

Whereas:

(1)

It transpires from Directive (EU) 2019/1024 that an EU-wide list of datasets with a particular potential to generate socio-economic benefits and with harmonised re-use conditions is a significant enabler of cross-border data applications and services.

(2)

The main objective of establishing the list of high-value datasets is to ensure that public data of highest socio-economic potential are made available for re-use with minimal legal and technical restriction and free of charge.

(3)

Harmonising the implementation of the re-use conditions of high-value datasets entails the technical specification for making the datasets available in a machine-readable format and via application programming interfaces (APIs). Making high-value datasets available under optimal conditions strengthens the open data policies in the Member States, building on the principles of findability, accessibility, interoperability and reusability (FAIR principles).

Annex I to Directive (EU) 2019/1024 lays down the themes of high-value datasets by listing six thematic data categories: 1) geospatial; 2) earth observation and environment; 3) meteorological; 4) statistics; 5) companies and company ownership; and 6) mobility.

(5)

Following a wide stakeholder consultation and given the result of the impact assessment for this Implementing Regulation, the Commission identified, within each of the six data categories, several datasets of particularly high value and the arrangements for their publication and re-use. The provisions of Union and Member State legislation that go beyond the minimum requirements set out in this Implementing Regulation, in particular in cases of sectoral law, are to continue to apply.

Pursuant to Directive (EU) 2019/1024, the requirement to make high-value datasets available free of charge shall not apply to libraries, including university libraries, museums and archives. Member States may exempt individual public sector bodies, upon their request and in line with the criteria set out in the Directive from the requirement to make high-value datasets available free of charge for a period not exceeding two years from the date of the entry into force of this Implementing Regulation.

(7)

Directive (EU) 2019/1024 stipulates in its Article 14(3) that this Implementing Regulation shall provide that the availability of high-value datasets free of charge is not to apply to specific high-value datasets held by public undertakings where that would lead to a distortion of competition in the relevant markets. However, data held by public undertakings are not included in the scope of this Implementing Regulation.

Where making high-value datasets available for re-use entails the processing of personal data, such processing should be carried out in accordance with Union law on the protection of individuals with regard to the processing of personal data, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council (2) and including any provisions of national law further specifying the application of the GDPR. Member States should make use of appropriate methods and techniques (such as generalisation, aggregation, suppression, anonymisation, differential privacy or randomisation), thus making as much data as possible available for re-use.

In addition to Directive (EU) 2019/1024, other Union legal acts, including Directive 2007/2/EC of the European Parliament and of the Council (3) and Directive 2005/44/EC of the European Parliament and of the Council (4) may be of relevance for the re-use of public sector information falling within the scope of this Implementing Regulation, notably where those Union acts lay down common requirements for data quality and interoperability.

Regarding all thematic categories, especially the category ‘companies and company ownership’, Member States are encouraged to go beyond the minimum requirements with respect to the scope of datasets and arrangements for re-use set out in this Regulation.

(11)

Member States should be able to complement the datasets listed in the Annex to this Regulation with public sector information already accessible, whenever such data are thematically related and considered of high value based on the criteria described under Article 14(2) of Directive (EU) 2019/1024. When this includes information that constitutes personal data, adding such information to the datasets must be necessary, proportionate and genuinely meet objectives of general interest.

It is the objective of Directive (EU) 2019/1024 to promote the use of standard public licences available online for re-using public sector information. The Commission’s Guidelines on recommended standard licences, datasets and charging for the re-use of documents (5) identify Creative Commons (‘CC’) licences as an example of recommended standard public licences. CC licences are developed by a non-profit organisation and have become a leading licensing solution for public sector information, research results and cultural domain material across the world. It is therefore necessary to refer in this Implementing Regulation to the most recent version of the CC licence suite, namely CC 4.0. A licence equivalent to the CC licence suite may include additional arrangements, such as the obligation on the re-user to include updates provided by the data holder and to specify when the data were last updated, as long as they do not restrict the possibilities for re-using the data.

The European Data Protection Supervisor was consulted in accordance with Article 42(1) of Regulation (EU) 2018/1725 of the European Parliament and of the Council (6) and delivered an opinion on 15 July 2022.

The measures set out in this Implementing Regulation are in accordance with the opinion of the Committee on open data and the re-use of public sector information set out in Article 16 of Directive (EU) 2019/1024,

HAS ADOPTED THIS REGULATION:

Article 1

Subject matter

1.   This Implementing Regulation establishes the list of high-value datasets belonging to the thematic categories set out in Annex I to Directive (EU) 2019/1024 and held by public sector bodies among the existing documents to which that Directive applies.

2.   This Implementing Regulation also lays down the arrangements for publishing and reusing high-value datasets, in particular the applicable conditions for re-use and the minimum requirements for disseminating data via application programming interfaces (‘APIs’).

Article 2

Definitions

For the purposes of this Implementing Regulation, the following definitions shall apply:

(1)

The definitions set out in Article 2 of Directive (EU) 2019/1024 shall apply.

(2)

The definitions set out for datasets in the geospatial, earth observation and environment and meteorological categories in Directive 2007/2/EC shall apply.

(3)

The definitions set out for datasets in the mobility category under Directive 2007/2/EC and Directive 2005/44/EC shall apply.

(4)

‘key attribute’ means a characteristic of an object or an entity in a dataset, such as a national identification code or name;

(5)

‘granularity’ means the level of detail of the dataset;

(6)

‘application programming interface (API)’ means a set of functions, procedures, definitions and protocols for machine-to-machine communication and the seamless exchange of data;

(7)

‘bulk download’ means a function that enables a download of an entire dataset in one or several packages.

Article 3

Arrangements for publication applicable to all categories of high-value datasets

1.   Public sector bodies holding high-value datasets listed in the Annex shall ensure that the datasets described or referenced in the Annex are made available in machine-readable formats via APIs corresponding to the reasonable needs of re-users. Where indicated in the Annex, the datasets shall also be made available as a bulk download.

2.   Those public sector bodies referred to in paragraph 1 shall set out and publish the terms of use of the API and the quality of service criteria on its performance, capacity and availability. The terms of use shall be available in a human-readable and machine-readable format. Both the terms of use and the quality of service criteria shall be compatible with the arrangements for the re-use of high-value datasets laid down in accordance with Article 4.

3.   API terms of use shall be accompanied by API documentation in a Union or internationally recognised open, human-readable and machine-readable format.

4.   Public sector bodies referred to in paragraph 1 shall designate a point of contact for questions and issues related to the API with a view to ensure the availability and maintenance of the API and ultimately the smooth and effective publication of the high-value datasets.

5.   Public sector bodies holding high-value datasets listed in the Annex shall ensure that the datasets are denoted as high-value datasets in their metadata description.

Article 4

Arrangements for re-use applicable to all categories of high-value datasets

1.   An exemption granted by a Member State in accordance with Article 14(5) of Directive (EU) 2019/1024 shall be published online, in the same way as the list of public sector bodies referred to in Article 6(3) of Directive (EU) 2019/1024.

2.   To facilitate the availability of datasets for re-use covering longer periods of time, the obligations imposed under this Regulation shall also apply to existing machine-readable high-value datasets created before the date of application of this Regulation.

3.   High-value datasets shall be made available for re-use under the conditions of the Creative Commons Public Domain Dedication (CC0) or, alternatively, the Creative Commons BY 4.0 licence, or any equivalent or less restrictive open licence, as set out in the Annex, allowing for unrestricted re-use. A requirement of attribution, giving the credit to the licensor, can additionally be required by the licensor.

4.   High-value datasets shall be made available in accordance with the arrangements for the publication and re-use as set out in the Annex.

Article 5

Reporting

1.   By 2 years after entry into force of this Implementing Regulation Member States shall provide the Commission with a report on the measures they have carried out to implement this Implementing Regulation. Where appropriate, the information under paragraph 3 can be provided through references to relevant metadata.

2.   Each Member State shall provide an updated version of the report upon the request of the Commission which should be made every 2 years.

3.   The report shall contain the following information:

(a)

a list of specific datasets at Member State level (and, where relevant, subnational level) corresponding to the description of each high-value dataset in the Annex to this Regulation and with online reference to metadata that follow existing standards, such as a single register or open data catalogue;

(b)

persistent link to the licensing conditions applicable to the re-use of high-value datasets listed in the Annex to this Regulation, per dataset referred to in point a);

(c)

persistent link to the APIs ensuring access to the high-value datasets listed in the Annex to this Regulation, per dataset referred to in point a);

(d)

where available, guidance documents issued by the Member State on publishing and reusing their high-value datasets;

(e)

where available, the existence of data protection impact assessments carried out in accordance with Article 35 of Regulation (EU) 2016/679;

(f)

the number of public sector bodies exempted in accordance with Article 14(5) of Directive (EU) 2019/1024.

Article 6

Entry into force and application

This Regulation shall enter into force on the twentieth day following that of its publication in the Official Journal of the European Union.

It shall apply from 16 months after entry into force of this Regulation.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

1.1.   Datasets in scope

The geospatial thematic category includes datasets within the scope of the INSPIRE data themes Administrative units, Geographical names, Addresses, Buildings and Cadastral parcels as defined in Annex I and Annex III to Directive 2007/2/EC of the European Parliament and of the Council (1). In addition, it includes Reference parcels and Agricultural parcels as defined in Regulation (EU) No 1306/2013 of the European Parliament and of the Council (2) and of Regulation (EU) No 1307/2013 of the European Parliament and of the Council (3) and the related delegated and implementing acts (4). Their granularity, geographical coverage and the key attributes are listed in the table below. If datasets are not available at the scale indicated in the table below, but are available at higher spatial resolution(s) (5), they shall be provided at the available spatial resolution.

1.2.   Arrangements for the publication and re-use

(a)

The datasets shall be made available for re-use:

under the conditions of the Creative Commons BY 4.0 licence or any equivalent or less restrictive open licence;

in a publicly documented, Union or internationally recognised open, machine-readable format;

through application programming interfaces (‘APIs’) (11) and bulk download;

in their most up-to-date version.

(b)

The metadata describing the datasets within the scope of the INSPIRE data themes shall contain at least the metadata elements set out in Commission Regulation (EC) No 1205/2008. (12)

(c)

For the implementation of the Reference parcels and Agricultural parcels datasets, Member States shall take into consideration the ongoing implementation of Directive 2007/2/EC as well as the obligation foreseen by Article 67(3) and 67(5) of Regulation (EU) 2021/2116.

2.   EARTH OBSERVATION AND ENVIRONMENT

2.1.   Datasets in scope

The earth observation and environmental category includes earth observation, including space-based or remotely-sensed data, as well as ground-based or in situ data, environmental and climate datasets within the scope of the INSPIRE data themes listed in the first table below and defined in Annexes I-III to Directive 2007/2/EC, and datasets produced or generated in the context of the legal acts listed in the second table below. The most up-to-date datasets as well as historical versions of datasets available in machine-readable format at all levels of generalisation available up to the scale of 1:5 000 covering the entire Member State when combined are included. If datasets are not available at this scale, but are available at higher spatial resolution(s) (13), they shall be provided at the available spatial resolution.

Furthermore, consistent with and without affecting the relevant access regimes as defined in Directive 2003/4/EC, the earth observation and environmental thematic category includes all “Environmental information”, as defined in Article 2 of Directive 2003/4/EC of the European Parliament and of the Council (14), and the environmental information listed in Directive 2003/4/EC, Article 7 “Dissemination of environmental information”.

The datasets shall be made available for re-use:

through APIs (42) and bulk download (for historical versions of datasets: APIs or bulk download, as feasible and appropriate).

b)

The metadata describing the data within the scope of the INSPIRE data themes set shall contain at least the metadata elements set out in the Annex to Regulation (EC) No 1205/2008.

c)

The datasets shall be described in a complete and publicly available online documentation describing at least the data structure and semantics.

d)

The datasets shall use Union or internationally recognised and publicly documented controlled vocabularies and taxonomies, where available.

3.   METEOROLOGICAL

3.1.   Datasets in scope

The meteorological thematic category includes datasets on observations data measured by weather stations, validated observations (climate data), weather alerts, radar data and numerical weather prediction (NWP) model data with the granularity and key attributes listed in the table below.

3.2.   Arrangements for the publication and re-use

a)

The datasets shall be made available for re-use:

under the conditions of the Creative Commons BY 4.0 licence or any equivalent or less restrictive open licence;

in any of the formats specified in the table below or another Union or internationally recognised open, machine-readable format;

through APIs and bulk download except for the dataset ‘NWP model data’ which shall be made available through APIs only;

pursuant to the update frequency and timeliness specified in the table below.

b)

The metadata describing the data set shall be complete and available on the web in an open and widely used machine-readable format.

c)

The datasets shall be described in a complete and publicly available online documentation describing at least the data structure and semantics (43).

4.   STATISTICS

4.1.   Datasets in scope

The statistics thematic category includes statistical datasets except microdata related to reporting obligations as defined in the legal acts listed in the table below.

In order to identify in a complete manner the relevant legal references in the legal acts, for some of the datasets it is necessary to refer to concepts from a number of provisions and Annexes, as presented below in Tables 1-18. For those datasets, the definitions from the legal acts referred to in the table below apply. The legal acts are also applicable where it is indicated so in the footnotes to Tables 1-18.

Time series shall begin no later than at the date of application of the respective legal act listed in the table below.
