declare that, by failing to notify the laws and regulations necessary for transposing into national law Directive 2002/39/EC of the European Parliament and of the Council of 10 June 2002 amending Directive 97/67/EC with regard to the further opening to competition of Community postal services, (1) the Republic of Estonia has failed to fulfil its obligations under the directive;

order the Republic of Estonia to pay the costs.

Pleas in law and main arguments

The period prescribed for transposing the directive into national law expired on 31 December 2002.
