Must Regulation (EC) No 1223/2009 of the European Parliament and of the Council of 30 November 2009 on cosmetic products (1) be interpreted as meaning that a product which does not come under Regulation No 1223/2009 must comply with the requirements of that regulation solely by reason of a statement on the outer packaging that the product is a ‘cosmetic eye accessory which is subject to the EU cosmetics directive’?

Must Regulation (EC) No 1223/2009 of the European Parliament and of the Council of 30 November 2009 on cosmetic products be interpreted as meaning that so-called themed contact lenses, which do not have any corrective function, come within the scope of that regulation?
