On 19 July 2011, the Commission received a request under Article 30(5) of Directive 2004/17/EC of the European Parliament and of the Council of 31 March 2004 coordinating the procurement procedures of entities operating in the water, energy, transport and postal services sectors (1).
This request from RWE Gas Storage, s.r.o. is in relation to gas storage in the Czech Republic. It was published in OJ C 228, 3.8.2011, p. 9. The initial deadline was 20 October 2011. This was extended to 20 January 2012 and the extension was published in OJ C 301, 12.10.2011, p. 12.
On 21 December 2011, the applicant withdrew the request, which is to be considered null and void. There is therefore no reason to decide whether Article 30(1) applies to these sectors in the Czech Republic. Directive 2004/17/EC therefore continues to apply when contracting entities award contracts concerning gas storage in the Czech Republic and when they organise competitive tendering for the pursuit of such an activity in this geographical area.
