    COMMISSION DECISION (EU) 2023/1665

    of 28 August 2023

    correcting Decision (EU) 2023/1409 instructing the Central Administrator of the Union Registry to return to the Member States and the United Kingdom the Union surplus at the end of the second commitment period of the Kyoto Protocol

    THE EUROPEAN COMMISSION,

    Having regard to the Treaty on the Functioning of the European Union,

    Having regard to Council Decision (EU) 2015/1339 of 13 July 2015 on the conclusion, on behalf of the European Union, of the Doha Amendment to the Kyoto Protocol to the United Nations Framework Convention on Climate Change and the joint fulfilment of commitments thereunder (1), and in particular Article 4 thereof,

    Whereas:

    (1)

    After the adoption of the Commission Decision (EU) 2023/1409 (2), the Commission identified an error in the calculation of the net Union surplus.

    (2)

    In order to ensure legal certainty, it is necessary to correct the above-mentioned Commission Decision and replace the Annex thereto, as regards the total amount of Union surplus and Member States’ allocated Union surplus.

    (3)

    After transferring the share of proceeds to the Adaptation Fund, there is a net Union surplus in the Union Registry of 2 156 103 762 assigned amount units as opposed to 2 215 147 885 referred to in the above-mentioned Commission Decision of 4 July 2023. These units should be returned to the Member States and the United Kingdom (3) in accordance with the rules set out in Article 4(2) of Decision (EU) 2015/1339.

    This Decision should enter into force on the day of its publication so that the Union surplus is returned to the Member States before 9 September 2023, the date when the additional period for fulfilling commitments under the Kyoto Protocol comes to its end,

    HAS DECIDED AS FOLLOWS:

    Article 1

    The Annex to the Decision (EU) 2023/1409 is replaced by the Annex to this Decision.

    Article 2

    This Decision shall enter into force on the day of its publication in the Official Journal of the European Union.
