    An action against the Italian Republic was brought before the Court of Justice of the European Communities on 17 May 2005 by the Commission of the European Communities, represented by K. Simonsson and C. Loggi, acting as Agents, with an address for service in Luxembourg.

    The applicant claims that the Court should:

    (1)

    declare that, by failing to adopt the laws, regulations and administrative provisions necessary to comply with Directive 2002/59/EC of the European Parliament and of the Council of 27 June 2002 establishing a Community vessel traffic monitoring and information system and repealing Council Directive 93/75/EEC (1) or, in any event, by failing to communicate to the Commission tht it had done so, the Italan Republic has failed to fulfil its oblgations under Article 29 of that directive.

    (2)

    order the Italian Republic to pay the costs.

    Pleas in law and main arguments:

    The time-limit for transposing the dirctive was 5 February 2004.
