    The Court:

    1.

    Dismisses the appeal and the cross-appeal;

    2.

    Orders Messrs Adrian Barnett and Sven-Ole Mogensen to bear their own costs and pay the costs incurred by the European Commission in the appeal;

    3.

    Orders the Commission to bear its own costs and pay the costs incurred by Messrs Barnett and Mogensen in the cross-appeal.
