Proposal for a Council Regulation on the conclusion of the Protocol establishing the fishing rights and financial compensation provided for in the Agreement between the European Economic Community and the Republic of Cape Verde on fishing off the coast of Cape Verde for the period from 6 September 1997 to 5 September 2000 (COM(97)0521 - C4-0566/97 - 97/0270(CNS))

Whereas on 12 December 1996 the European Parliament, the Council and the Commission signed a joint declaration on improving the information of the budgetary authority on international fishing agreements(1).

Whereas in its resolution of 15 May 1997 on international fisheries agreements(1), the European Parliament gave its views on the principles (paragraph 16) and guidelines (paragraph 24) to be laid down,

Whereas it is important to provide better information for the European Parliament; whereas the Commission should therefore draw up a report on the progress made in applying this Agreement;

Article 2a

During the final year of application of the Protocol and before any agreement to renew it is concluded, the Commission shall submit to the Council and the European Parliament a report on the application and conditions of implementation of the Agreement, in particular its impact on the level of fish stocks and the scientific activities financed in the context of this Protocol.

Legislative resolution embodying Parliament's opinion on the proposal for a Council Regulation on the conclusion of the Protocol establishing the fishing rights and financial compensation provided for in the Agreement between the European Economic Community and the Republic of Cape Verde on fishing off the coast of Cape Verde for the period from 6 September 1997 to 5 September 2000 (COM(97)0521 - C4-0566/97 - 97/0270(CNS))

(Consultation procedure)

The European Parliament,

- having regard to the Commission proposal to the Council, COM(97)0521 - 97/0270(CNS),

- having been consulted by the Council pursuant to Article 43, in conjunction with Article 228(3), first subparagraph, of the EC Treaty (C4-0566/97),

- having regard to Rule 58 of its Rules of Procedure,

- having regard to the report of the Committee on Fisheries and the opinions of the Committee on Budgets and the Committee on Development and Cooperation (A4-0363/97),

1. Approves the Commission proposal, subject to Parliament's amendments;

2. Calls on the Council to notify Parliament should it intend to depart from the text approved by Parliament;

3. Asks to be consulted again should the Council intend to make substantial modifications to the Commission proposal;

4. Instructs its President to forward this opinion to the Council and Commission.
