COMMISSION IMPLEMENTING REGULATION (EU) 2025/2149
of 24 October 2025
amending Implementing Regulation (EU) 2021/1976 imposing a definitive anti-dumping duty on imports of mono ethylene glycol originating in the United States of America and the Kingdom of Saudi Arabia
THE EUROPEAN COMMISSION,
Having regard to the Treaty on the Functioning of the European Union,
Having regard to Regulation (EU) 2016/1036 of the European Parliament and of the Council of 8 June 2016 on protection against dumped imports from countries not members of the European Union (1), and in particular Article 14(1) thereof,

Imports of mono ethylene glycol originating in the United States of America and the Kingdom of Saudi Arabia are subject to definitive anti-dumping duties imposed by Commission Implementing Regulation (EU) 2021/1976 (2). |

On 12 December 2024, INEOS Americas LLC (‘INEOS Americas’) informed the authorities of Belgium that, effective as of 1 May 2024, it had acquired the mono ethylene glycol business, including the production facility, of Equistar Chemicals, LP (TARIC (3) additional code C682) and that therefore the name of Equistar Chemicals, LP in Implementing Regulation (EU) 2021/1976 should be replaced by INEOS Americas. The company is subject to an anti-dumping duty of 10,3 % foreseen for non-sampled cooperating companies in the United States of America. |

INEOS Americas requested to confirm that the change of name does not affect the company’s right to benefit from the anti-dumping duty rate applied to it under its previous name. |

On 24 December 2024, the authorities of Belgium forwarded the request to the Commission. |

The Commission sent a questionnaire to INEOS Americas, examined the information supplied, requested additional clarification and concluded that the change of name was properly registered with the relevant authorities on 1 May 2024 and that it did not result in any new relationship with other groups of exporting producers which were not investigated by the Commission. |

Accordingly, this change of name does not affect the findings of Implementing Regulation (EU) 2021/1976 and in particular the anti-dumping duty rate applicable to the company. |

(7) |
The name change should take effect as of 1 May 2024, the date on which the acquisition became effective and was registered with the relevant authorities. |

Given the considerations in the recitals above, the Commission considered it appropriate to amend Implementing Regulation (EU) 2021/1976 to reflect the changed name of the company previously attributed to additional TARIC code C682. |

The Commission informed all interested parties of the essential facts and considerations on the basis of which it intended to change the name Equistar Chemicals, LP into INEOS Americas (‘final disclosure’). All parties were granted a period within which they could make comments on the final disclosure. No comments were received. |

The measures provided for in this Regulation are in accordance with the opinion of the Committee established by Article 15(1) of Regulation (EU) 2016/1036, |
HAS ADOPTED THIS REGULATION:
Article 1
1. The Annex to Implementing Regulation (EU) 2021/1976 is amended as follows:

2. The TARIC additional code C682 previously attributed to Equistar Chemicals, LP shall apply to INEOS Americas LLC, as of 1 May 2024. Any definitive duty paid as of 1 May 2024 on imports of products manufactured by INEOS Americas LLC in excess of the anti-dumping duty established in Article 1(2) of Implementing Regulation (EU) 2021/1976 as regards Equistar Chemicals, LP shall be repaid or remitted in accordance with the applicable customs legislation.
Article 2
This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.
This Regulation shall be binding in its entirety and directly applicable in all Member States.
