implementing Regulation (EU) No 269/2014 concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine

THE COUNCIL OF THE EUROPEAN UNION,

Having regard to the Treaty on the Functioning of the European Union,

Having regard to Council Regulation (EU) No 269/2014 of 17 March 2014 concerning restrictive measures in respect of actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine (1), and in particular Article 14(1) and (3) thereof,

Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,

Whereas:

(1)

On 17 March 2014, the Council adopted Regulation (EU) No 269/2014.

(2)

On the basis of a review by the Council, the information concerning 126 individuals and 36 entities in Annex I to Regulation (EU) No 269/2014 should be updated. Additionally, the entries for three deceased persons and four other persons, as well as three duplicate entries should be deleted from that Annex.

(3)

Regulation (EU) No 269/2014 should therefore be amended accordingly,

HAS ADOPTED THIS REGULATION:

Article 1

Annex I to Regulation (EU) No 269/2014 is amended in accordance with the Annex to this Regulation.

Article 2

This Regulation shall enter into force on the day following that of its publication in the Official Journal of the European Union.

This Regulation shall be binding in its entirety and directly applicable in all Member States.

For his involvement in the annexation process he has been awarded with Russian State order “For Merit to the Fatherland” – first degree.

As Vice Speaker of the Verkhovna Rada of Crimea, Sergey Tsekov initiated, together with Sergey Aksyonov, the unlawful dismissal of the government of the Autonomous “Republic of Crimea” (ARC). He drew Vladimir Konstantinov into this endeavour, threatening him with dismissal. He publicly recognised that the MPs from Crimea were the initiators of inviting Russian soldiers to take over the Verkhovna Rada of Crimea. He was one of the first Crimean Leaders to ask in public for the annexation of Crimea to Russia.

Sergey Tsekov is a former member of the Federation Council of the Russian Federation from the so-called “Republic of Crimea”. He is currently First Deputy Chairman of the State Council of the so-called “Republic of Crimea”.

General of the Russian Armed Forces. He was the top battlefield commander of Russia’s military aggression against Ukraine between April and June 2022. In that capacity, he was responsible for all military operations against Ukraine. Therefore, Alexander Dvornikov actively supported and implemented actions or policies which undermine or threaten the territorial integrity, sovereignty and independence of Ukraine, as well as stability and security in Ukraine.

He is currently Chairman of the Voluntary Society for Assistance to the Army, Aviation and Navy of Russia.

Former Commander of the Southern Military District of the Russian Armed Forces. In that capacity, he was responsible for military forces in the region, including illegally annexed Crimea and Sevastopol. In this role, he was responsible for the actions of the Black Sea Fleet and other military forces of the Russian Federation against Ukraine on 25 November 2018 which prevented access by Ukrainian vessels to their coast on the Sea of Azov, thereby undermining the territorial integrity and sovereignty of Ukraine and undermining the security of Ukraine through the disruption of the movements and operability of Ukrainian naval vessels.

Those actions also supported the consolidation of the illegal annexation of the Crimean peninsula into the Russian Federation.

Oleksandr Yanukovych is a businessperson and the son of former President of Ukraine Viktor Yanukovych. During the presidency of Viktor Yanukovych and thanks to the personal connection with a group of persons close to his father, he assembled an array of business interests and accumulated a great fortune. He still runs his business activities in the Donbass region controlled by the separatist groups, especially in the energy, coal, construction, banking and real estate sectors. In particular, thanks to close ties with the pro-Russian separatists, he acquired key economic assets in the so-called “Donetsk and Luhansk People’s Republics”, inter alia in the energy, coal and real-estate sectors. The separatist OPLOT battalion (listed since February 2015) protected his real-estate development projects in the so-called “Donetsk People’s Republic”.

Oleksandr Yanukovych’s MAKO Holding company was officially transferred to Russian jurisdiction and is now registered in Donetsk. Prior to the transition to Russian jurisdiction, the MAKO group of companies was de jure under Ukrainian jurisdiction.

Therefore, Oleksandr Yanukovych is responsible for supporting or implementing actions or policies which undermine or threaten the territorial integrity, sovereignty and independence of Ukraine and he conducted transactions with the separatist groups in the Donbas region of Ukraine.

Furthermore, he is associated with his father Viktor Yanukovych, who is responsible for supporting or implementing actions or policies which threaten the territorial integrity, sovereignty and independence of Ukraine, as well as the state’s stability and security.

Andrei Leonidovich Kostin is the president-chairman of Vneshtorbank (VTB) – one of the leading state-owned banks in Russia. He has been the chairman of the Board of Directors of the United Shipbuilding Corporation since 25 August 2023 and is a member of the Supreme Council of the “United Russia” political party.

He has made public statements supporting the annexation of Crimea and encouraging Russian citizens to vacation in Crimea. He is also associated with, and according to media reports is an owner of, a winery and a luxurious hotel in Crimea.

He is therefore supporting actions and policies that undermine the territorial integrity of Ukraine and benefitting from the annexation of Crimea.

Yevgeniy Prigozhin was a Russian leading businessperson with close ties to the President of the Russian Federation Vladimir Putin and the Russian Ministry of Defence. He reportedly died in a plane crash on 23 August 2023.

He publicly confirmed that he founded the Wagner Group, a Russia-based unincorporated military entity, responsible for the deployment of Wagner Group mercenaries in Ukraine. In 2022, a joint stock company called “PMC Wagner Center” was established and registered in Saint Petersburg, with the aim of “providing a comfortable environment for generating new ideas to improve Russia’s defence capability”. The Wagner Group, led by Yevgeniy Prigozhin, has played an important role in the fighting in and occupation of territories in Eastern Ukraine.

Concord, also known as KOMBINAT PITANIYA KONKORD OOO, a company which Prigozhin founded and owned until November 2019, and a group of other companies with ties to him, including Concord Management and Consulting LLC and Megaline LLC, have been benefitting from large public contracts with the Russian Ministry of Defence following the illegal annexation of Crimea by the Russian Federation and the occupation of Eastern Ukraine by Russia-backed separatists.

Yevgeniy Prigozhin was a leading businessperson operating in Russia. He was responsible for and actively implemented actions which have undermined and threatened the territorial integrity, sovereignty and independence of Ukraine. Moreover, he benefitted from Russian decision-makers responsible for the annexation of Crimea and the destabilisation of Eastern Ukraine.

Yevgeniy Prigozhin’s son, Pavel Prigozhin, is the primary heir and beneficiary of his assets, possessions, and properties. Pavel Prigozhin is listed by the Union for his involvement in military operations against Ukraine. Therefore, it is appropriate to retain Yevgeniy Prigozhin on the list of natural or legal persons, entities or bodies subject to the asset freeze and the prohibition on making funds and economic resources available as there is a likelihood that the assets concerned would otherwise be used to finance Russia’s war of aggression against Ukraine or other actions undermining or threatening the territorial integrity, sovereignty and independence of Ukraine.

In those capacities, he has been responsible for supervising the security of the border in the Gomel oblast, including the border between Belarus and Ukraine, and the passage of individuals and goods through this border. Russian troops crossed the border between Belarus and Ukraine in the Gomel oblast as part of Russia’s war of aggression against Ukraine on 24 February 2022.
