repealing Decision (CFSP) 2022/1236 on an assistance measure under the European Peace Facility to support the Nigerien Armed Forces
THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on European Union, and in particular Article 28(1) and Article 41(2) thereof,
Having regard to the proposal from the High Representative of the Union for Foreign Affairs and Security Policy,
Whereas:

On 18 July 2022, the Council adopted Decision (CFSP) 2022/1236 (1) which established an assistance measure under the European Peace Facility to support the Nigerien Armed Forces. |

(2) |
On 26 July 2023, pursuant to Article 64(1), point (b), of Council Decision (CFSP) 2021/509 (2), the High Representative of the Union for Foreign Affairs and Security Policy provisionally suspended the assistance measure in support of the Nigerien Armed Forces as, following the coup in Niger, the situation no longer allowed for the assistance measure to be implemented whilst ensuring sufficient guarantees. |

On 23 April 2024, the Political and Security Committee, pursuant to Article 64(2) of Decision (CFSP) 2021/509, recommended to the Council the termination of the assistance measure established by Decision (CFSP) 2022/1236. |

The assistance measure in support of the Nigerien Armed Forces should be terminated and Decision (CFSP) 2022/1236 should therefore be repealed, |
HAS ADOPTED THIS DECISION:
Article 1
1. The assistance measure under the European Peace Facility to support the Nigerien Armed Forces, established by Decision (CFSP) 2022/1236, is hereby terminated.
2. Decision (CFSP) 2022/1236 is repealed.
3. The provisions of Decision (CFSP) 2022/1236 shall continue to apply to the implementation of expenditure committed up to the date of entry into force of this Decision and to the related accounting and inventory, auditing and presentation of accounts, and liability, until a discharge has been granted to the administrator for assistance measures for such expenditure. Costs related to the termination of the contract between the Administrator for Assistance Measures and the Implementing Actor shall be deemed eligible.
Article 2
This Decision shall enter into force on the date of its adoption.
