COUNCIL DECISION
of 5 November 2024
adopting the Council’s position on draft amending budget No 5 of the European Union for the financial year 2024

THE COUNCIL OF THE EUROPEAN UNION,
Having regard to the Treaty on the Functioning of the European Union, and in particular Article 314 thereof, in conjunction with the Treaty establishing the European Atomic Energy Community, and in particular Article 106a thereof,
Regulation (EU, Euratom) 2024/2509 of the European Parliament and of the Council of 23 September 2024 on the financial rules applicable to the general budget of the Union (recast) (1), and in particular Article 44 thereof,
Whereas:

the Union’s budget for the financial year 2024 was definitively adopted on 22 November 2023 (2); |
– |
on 10 October 2024, the Commission submitted a proposal containing draft amending budget No 5 to the general budget for the financial year 2024; |
– |
the Council needs to proceed without delay with the adoption of its position on draft amending budget No 5 to the general budget for 2024, in view of urgently (a) increasing the level of payment appropriations for the European Regional Development Fund (ERDF), including in relation to the reprogramming related to the Strategic Technologies for Europe Platform (STEP), (b) updating the needs for the Sustainable Fisheries Partnership Agreements (SFPAs), taking into account that several agreements and the related protocols will not be concluded in 2024, (c) increasing the appropriations, linked to the most recent estimates for the update of remuneration in and outside heading 7 to several decentralised agencies, (d) adjusting the EU contribution to the European Union Agency for Law Enforcement Training (CEPOL), the European Union Agency for the operational management of large-scale IT systems in the area of freedom, security and justice (eu-LISA), the European Union Agency for Asylum (EUAA), the Anti-Money Laundering Authority (AMLA), the European Chemicals Agency (ECHA) and the European Environment Agency (EEA), (e) reducing the appropriations of the Publication Office following the introduction of machine translation and (f) updating the revenue side of the budget. It is therefore justified to provide for an exception to the eight-week period referred to in Article 4 of Protocol No 1 on the role of national Parliaments in the European Union, annexed to the Treaty on European Union, to the Treaty on the Functioning of the European Union and to the Treaty establishing the European Atomic Energy Community. |

The Council’s position on draft amending budget No 5 of the European Union for the financial year 2024 was adopted on 5 November 2024.
