    COMMISSION IMPLEMENTING REGULATION (EU) 2022/980

    of 23 June 2022

    amending Implementing Regulation (EU) No 75/2013 as regards the additional import duties in the sugar sector

    THE EUROPEAN COMMISSION,

    Having regard to the Treaty on the Functioning of the European Union,

    Having regard to Regulation (EU) No 1308/2013 of the European Parliament and of the Council of 17 December 2013 establishing a common organisation of the markets in agricultural products and repealing Council Regulations (EEC) No 922/72, (EEC) No 234/79, (EC) No 1037/2001 and (EC) No 1234/2007 (1), and in particular Article 182(4) thereof,

    Whereas:

    Article 36 of Commission Regulation (EC) No 951/2006 (2) provides for additional import duties for certain products in the sugar sector.

    (2)

    In view of the market conditions and forecast prevailing at the time, Commission Implementing Regulation (EU) No 75/2013 (3) provided that the additional import duties are not to apply to several sugar products until 30 September 2015. As the prevailing market conditions did not substantially change following that date, Commission Implementing Regulation (EU) No 1278/2014 (4) extended that period until 30 September 2017 and Commission Implementing Regulation (EU) 2017/1409 (5) further extended it until 30 September 2022.

    According to Article 182(2) of Regulation (EU) No 1308/2013, additional import duties are not to be imposed where the imports are unlikely to disturb the Union market, or where the effects would be disproportionate to the intended objective. Taking into account the fundamentals of the world and the Union sugar markets, the imports of sugar products subject to the import duty provided for in the Common Customs Tariff will remain unlikely to disturb the Union market. Consequently, no additional duties should apply to those imports, unless the market situation changes significantly.

    Therefore, the period during which additional import duties are not to apply to several sugar products, provided for in Article 1 of Implementing Regulation (EU) No 75/2013, should be extended.

    (5)

    Implementing Regulation (EU) No 75/2013 should therefore be amended accordingly.

    (6)

    In the interest of legal certainty, this Regulation should apply from the day following that of the expiry of the period provided for in Article 1 of Implementing Regulation (EU) No 75/2013.

    (7)

    The measures provided for in this Regulation are in accordance with the opinion of the Committee for the Common Organisation of the Agricultural Markets,

    HAS ADOPTED THIS REGULATION:

    Article 1

    In Article 1 of Implementing Regulation (EU) No 75/2013, the date ‘30 September 2022’ is replaced by ‘30 September 2027’.

    Article 2

    This Regulation shall enter into force on the third day following that of its publication in the Official Journal of the European Union.

    It shall apply from 1 October 2022.

    This Regulation shall be binding in its entirety and directly applicable in all Member States.
