DECISION OF THE EEA JOINT COMMITTEE No 210/2018

of 26 October 2018

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2021/493]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Delegated Directive (EU) 2018/736 of 27 February 2018 amending, for the purposes of adapting to scientific and technical progress, Annex III to Directive 2011/65/EU of the European Parliament and of the Council as regards an exemption for certain electrical and electronic components containing lead in glass or ceramic (1) is to be incorporated into the EEA Agreement.

(2)

Commission Delegated Directive (EU) 2018/737 of 27 February 2018 amending, for the purposes of adapting to scientific and technical progress, Annex III to Directive 2011/65/EU of the European Parliament and of the Council as regards an exemption for lead in solders for the soldering to machined through hole discoidal and planar array ceramic multilayer capacitors (2) is to be incorporated into the EEA Agreement.

Commission Delegated Directive (EU) 2018/738 of 27 February 2018 amending, for the purposes of adapting to scientific and technical progress, Annex III to Directive 2011/65/EU of the European Parliament and of the Council as regards an exemption for lead in cermet-based trimmer potentiometer elements (3) is to be incorporated into the EEA Agreement.

Commission Delegated Directive (EU) 2018/739 of 1 March 2018 amending, for the purposes of adapting to scientific and technical progress, Annex III to Directive 2011/65/EU of the European Parliament and of the Council as regards an exemption for lead as an alloying element in steel (4) is to be incorporated into the EEA Agreement.

Commission Delegated Directive (EU) 2018/740 of 1 March 2018 amending, for the purposes of adapting to scientific and technical progress, Annex III to Directive 2011/65/EU of the European Parliament and of the Council as regards an exemption for lead as an alloying element in aluminium (5) is to be incorporated into the EEA Agreement.

Commission Delegated Directive (EU) 2018/741 of 1 March 2018 amending, for the purposes of adapting to scientific and technical progress, Annex III to Directive 2011/65/EU of the European Parliament and of the Council as regards an exemption for lead as an alloying element in copper (6) is to be incorporated into the EEA Agreement.

Commission Delegated Directive (EU) 2018/742 of 1 March 2018 amending, for the purposes of adapting to scientific and technical progress, Annex III to Directive 2011/65/EU of the European Parliament and of the Council as regards an exemption for lead in high melting temperature solders (7) is to be incorporated into the EEA Agreement.

Annex II to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

The following indents are added in point 12q (Directive 2011/65/EU of the European Parliament and of the Council) of Chapter XV of Annex II to the EEA Agreement:

32018 L 0741: Commission Delegated Directive (EU) 2018/741 of 1 March 2018 (OJ L 123, 18.5.2018, p. 109),

32018 L 0742: Commission Delegated Directive (EU) 2018/742 of 1 March 2018 (OJ L 123, 18.5.2018, p. 112).’

Article 2

The texts of Delegated Directives (EU) 2018/736, (EU) 2018/737, (EU) 2018/738, (EU) 2018/739, (EU) 2018/740, (EU) 2018/741 and (EU) 2018/742 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 27 October 2018, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
