    DECISION OF THE EEA JOINT COMMITTEE

    No 84/2017

    of 5 May 2017

    amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement [2019/196]

    THE EEA JOINT COMMITTEE,

    Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

    Whereas:

    (1)

    Commission Implementing Regulation (EU) 2016/662 of 1 April 2016 concerning a coordinated multiannual control programme of the Union for 2017, 2018 and 2019 to ensure compliance with maximum residue levels of pesticides and to assess the consumer exposure to pesticide residues in and on food of plant and animal origin (1) is to be incorporated into the EEA Agreement.

    (2)

    Implementing Regulation (EU) 2016/662 repeals Commission Implementing Regulation (EU) 2015/595 (2), which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement

    (3)

    This Decision concerns legislation regarding foodstuffs. Legislation regarding foodstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the introduction to Chapter XII of Annex II to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

    Annex II to the EEA Agreement should therefore be amended accordingly,

    HAS ADOPTED THIS DECISION:

    Article 1

    Chapter XII of Annex II to the EEA Agreement shall be amended as follows:

    (1)

    The following is inserted after point 120 (Commission Regulation (EU) 2016/1412) of Chapter XII of Annex II to the EEA Agreement:

    32016 R 0662: Commission Implementing Regulation (EU) 2016/662 of 1 April 2016 concerning a coordinated multiannual control programme of the Union for 2017, 2018 and 2019 to ensure compliance with maximum residue levels of pesticides and to assess the consumer exposure to pesticide residues in and on food of plant and animal origin (OJ L 115, 29.4.2016, p. 2).

    The provisions of the Regulation shall, for the purposes of this Agreement, be read with the following adaptation:

    In the table in point (5) in annex II, the following shall be added:

    (2)

    The text of point 102 (Commission Implementing Regulation (EU) 2015/595) is deleted.

    Article 2

    The text of Implementing Regulation (EU) 2016/662 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

    Article 3

    This Decision shall enter into force on 6 May 2017, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

    Article 4

    This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
