DECISION OF THE EEA JOINT COMMITTEE

No 82/2007

of 6 July 2007

amending Annex II (Technical regulations, standards, testing and certification) to the EEA Agreement

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area, as amended by the Protocol adjusting the Agreement on the European Economic Area, hereinafter referred to as ‘the Agreement’, and in particular Article 98 thereof,

Whereas:

(1)

Annex II to the Agreement was amended by Decision of the EEA Joint Committee No 48/2007 of 8 June 2007 (1).

(2)

Commission Directive 2006/10/EC of 27 January 2006 amending Council Directive 91/414/EEC to include forchlorfenuron and indoxacarb as active substances (2) is to be incorporated into the Agreement.

(3)

Directive 2005/90/EC of the European Parliament and of the Council of 18 January 2006 amending, for the 29th time, Council Directive 76/769/EEC on the approximation of the laws, regulations and administrative provisions of the Member States relating to restrictions on the marketing and use of certain dangerous substances and preparations (3) is to be incorporated into the Agreement.

(4)

Commission Directive 2006/16/EC of 7 February 2006 amending Council Directive 91/414/EEC to include oxamyl as active substance (4) is to be incorporated into the Agreement.

(5)

Commission Directive 2006/19/EC of 14 February 2006 amending Council Directive 91/414/EEC to include 1-methylcyclopropene as active substance (5) is to be incorporated into the Agreement.

(6)

Commission Directive 2006/39/EC of 12 April 2006 amending Council Directive 91/414/EEC to include clodinafop, pirimicarb, rimsulfuron, tolclofos-methyl and triticonazole as active substances (6) is to be incorporated into the Agreement.

(7)

Commission Decision 2006/310/EC of 21 April 2006 amending, for the purposes of adapting to the technical progress, the Annex to Directive 2002/95/EC of the European Parliament and of the Council as regards exemptions for applications of lead (7) is to be incorporated into the Agreement,

HAS DECIDED AS FOLLOWS:

Article 1

Chapter XV of Annex II to the Agreement shall be amended as follows:

1.

the following indent shall be added in point 4 (Council Directive 76/769/EEC):

‘—

32005 L 0090: Directive 2005/90/EC of the European Parliament and of the Council of 18 January 2006 (OJ L 33, 4.2.2006, p. 28).’;

2.

the following indents shall be added in point 12a (Council Directive 91/414/EEC):

‘—

32006 L 0010: Commission Directive 2006/10/EC of 27 January 2006 (OJ L 25, 28.1.2006, p. 24),

32006 L 0016: Commission Directive 2006/16/EC of 7 February 2006 (OJ L 36, 8.2.2006, p. 37),

32006 L 0019: Commission Directive 2006/19/EC of 14 February 2006 (OJ L 44, 15.2.2006, p. 15),

32006 L 0039: Commission Directive 2006/39/EC of 12 April 2006 (OJ L 104, 13.4.2006, p. 30).’;

3.

the following indent shall be added in point 12q (Directive 2002/95/EC of the European Parliament and of the Council):

‘—

32006 D 0310: Commission Decision 2006/310/EC of 21 April 2006 (OJ L 115, 28.4.2006, p. 38).’

Article 2

The texts of Directives 2006/10/EC, 2005/90/EC, 2006/16/EC, 2006/19/EC and 2006/39/EC and Decision 2006/310/EC in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 7 July 2007, provided that all the notifications under Article 103(1) of the Agreement have been made to the EEA Joint Committee (8).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
