    Collecting data to assist in fisheries sector management

     

    SUMMARY OF:

    Regulation (EU) 2017/1004 – setting out rules for the collection, management and use of data in the fisheries sector and support for scientific advice regarding the common fisheries policy

    WHAT IS THE AIM OF THE REGULATION?

    • Regulation (EU) 2017/1004 sets out rules on collecting, managing and using biological, environmental, technical and socioeconomic data in the fisheries sector*. These data are used for informed decision-making in sustainable fisheries management and for the evaluation and monitoring of fish stocks and ecosystems.
    • Regulation (EU) 2021/1139 establishes the 2021–2027 European Maritime, Fisheries and Aquaculture Fund (see summary) and amends Regulation (EU) 2017/1004.

    KEY POINTS

    The European Union (EU) Member States must collect data on the fisheries and aquaculture sectors on the basis of a multiannual programme compiling a detailed list of data requirements and the list of mandatory research surveys at sea.

    The data to be collected include:

    • biological data on all stocks caught in EU fisheries in and outside EU waters, including eels and salmon in inland waters, to enable an ecosystem-based approach to fisheries management and conservation in line with the common fisheries policy;
    • data to assess the impact of EU fisheries on the marine ecosystem in and outside EU waters, including data on incidental catches of sensitive species and on the impact on marine habitats and food webs*;
    • data on the activity of EU fishing vessels in and outside EU waters, including levels of fishing and the capacity of the fleet;
    • socioeconomic data on fisheries, to allow for the assessment of the socioeconomic performance of the EU fisheries sector;
    • socioeconomic and sustainability data on marine aquaculture (and in some circumstances freshwater aquaculture), so that their performance and environmental impact can be assessed;
    • socioeconomic data on the fish processing sector, so that its performance can be assessed.

    Each Member State must produce a national work plan, in accordance with the multiannual programme and financial rules of the European Maritime, Fisheries and Aquaculture Fund.

    Under Amending Regulation (EU) 2021/1139, national work plans must be submitted to the European Commission by electronic means by 15 October of the year preceding the year to which they apply.

    The national work plans are evaluated by the Scientific, Technical and Economic Committee for Fisheries and include information on:

    • the frequency of data collection;
    • data sources;
    • procedures and methods to collect and process the data;
    • quality assurance and control;
    • data format;
    • when the data are to be made available to end-users;
    • international and regional cooperation and coordination;
    • how the international obligations of the EU are taken into account.

    The Commission then adopts implementing acts approving the national work plans by 31 December of the year preceding the year from which the national work plan is to apply.

    The regulation also includes information on the data management process and how the data are made available, on the regional coordination among Member States and regional work plans that it can produce, as well as the obligations of the end-users of scientific data and other interested parties.

    Delegated and implementing acts

    The Commission has adopted several delegated and implementing acts in relation to Regulation (EU) 2017/1004.

    • Delegated Decision (EU) 2021/1167, which sets out the multiannual EU programme for the collection and management of biological, environmental, technical and socioeconomic data in the fisheries and aquaculture sectors from 1 January 2022. As of 31 December 2021, it repeals and replaces Delegated Decision (EU) 2019/910 on a similar multiannual programme covering the 2020–2021 period.
    • Implementing Decision (EU) 2021/1168, which establishes the list of mandatory research surveys at sea and thresholds as part of the multiannual programme (from 2022) and which repeals Implementing Decision (EU) 2019/909 which covered the 2020–2021 period.
    • Implementing Decision (EU) 2018/1283, on rules on the format and timetables for the submission of annual data collection reports in the fisheries and aquaculture sectors.
    • Implementing Decision (EU) 2016/1701, on rules on the format for the submission of national work plans for data collection in the fisheries and aquaculture sectors.

    FROM WHEN DOES THE REGULATION APPLY?

    It has applied since 10 July 2017. Regulation (EU) 2017/1004 revised and replaced Regulation (EC) No 199/2008 and its subsequent amendments.

    Fisheries sector. Activities related to commercial fisheries, recreational fisheries, aquaculture and industries which process fisheries products.
    Food web. Interconnected food chains (feeding relationships) in an ecosystem. Plants, herbivores, and carnivores all form parts of the food web.
