DECISION OF THE EEA JOINT COMMITTEE

No 6/2017

of 3 February 2017

amending Annex I (Veterinary and phytosanitary matters) to the EEA Agreement [2018/1740]

THE EEA JOINT COMMITTEE,

Having regard to the Agreement on the European Economic Area (‘the EEA Agreement’), and in particular Article 98 thereof,

Whereas:

(1)

Commission Implementing Regulation (EU) 2016/1768 of 4 October 2016 concerning the authorisation of guanidinoacetic acid as a feed additive for chickens for fattening, weaned piglets and pigs for fattening and repealing Commission Regulation (EC) No 904/2009 (1) is to be incorporated into the EEA Agreement.

(2)

Commission Implementing Regulation (EU) 2016/1833 of 17 October 2016 concerning the authorisation of a preparation of kidney bean lectins (Phaseolus vulgaris lectins) as a feed additive for suckling piglets (holder of authorisation Biolek Sp. z o.o.) (2) is to be incorporated into the EEA Agreement.

Commission Implementing Regulation (EU) 2016/1881 of 24 October 2016 amending Implementing Regulation (EU) No 837/2012 as regards the minimum activity of 6-phytase produced by Aspergillus oryzae (DSM 22594) as feed additive for sows (holder of authorisation DSM Nutritional Products Ltd) (3) is to be incorporated into the EEA Agreement.

Implementing Regulation (EU) 2016/1768 repeals Commission Regulation (EC) No 904/2009 (4) which is incorporated into the EEA Agreement and which is consequently to be repealed under the EEA Agreement.

This Decision concerns legislation regarding feedingstuffs. Legislation regarding feedingstuffs shall not apply to Liechtenstein as long as the application of the Agreement between the European Community and the Swiss Confederation on trade in agricultural products is extended to Liechtenstein, as specified in the sectoral adaptations to Annex I to the EEA Agreement. This Decision is therefore not to apply to Liechtenstein.

Annex I to the EEA Agreement should therefore be amended accordingly,

HAS ADOPTED THIS DECISION:

Article 1

Chapter II of Annex I to the EEA Agreement shall be amended as follows:

(1)

The following indent is added in point 55 (Commission Implementing Regulation (EU) No 837/2012):

‘—

32016 R 1881: Commission Implementing Regulation (EU) 2016/1881 of 24 October 2016 (OJ L 289, 25.10.2016, p. 15).’

(2)

The following points are inserted after point 174 (Commission Implementing Regulation (EU) 2016/1220):

‘175.

32016 R 1768: Commission Implementing Regulation (EU) 2016/1768 of 4 October 2016 concerning the authorisation of guanidinoacetic acid as a feed additive for chickens for fattening, weaned piglets and pigs for fattening and repealing Commission Regulation (EC) No 904/2009 (OJ L 270, 5.10.2016, p. 4).

32016 R 1833: Commission Implementing Regulation (EU) 2016/1833 of 17 October 2016 concerning the authorisation of a preparation of kidney bean lectins (Phaseolus vulgaris lectins) as a feed additive for suckling piglets (holder of authorisation Biolek Sp. z o.o.) (OJ L 280, 18.10.2016, p. 19).’

The text of point 1zzzzzo (Commission Regulation (EC) No 904/2009) is deleted.

Article 2

The texts of Implementing Regulations (EU) 2016/1768, (EU) 2016/1833 and (EU) 2016/1881 in the Icelandic and Norwegian languages, to be published in the EEA Supplement to the Official Journal of the European Union, shall be authentic.

Article 3

This Decision shall enter into force on 4 February 2017, provided that all the notifications under Article 103(1) of the EEA Agreement have been made (*1).

Article 4

This Decision shall be published in the EEA Section of, and in the EEA Supplement to, the Official Journal of the European Union.
