Legislative resolution embodying Parliament's opinion on the proposal for a Council Directive amending Council Directive 95/21/EC concerning the enforcement, in respect of shipping using Community ports and sailing in the waters under the jurisdiction of the Member States, of international standards for ship safety, pollution prevention and shipboard living and working conditions (port State control) (COM(97)0416 - C4-0456/97 - 97/0215(SYN)) (Cooperation procedure: first reading) The European Parliament, - having regard to the Commission proposal to the Council, COM(97)0416 - 97/0215(SYN) ((OJ C 264, 30.8.1997, p. 33.)), - having been consulted by the Council pursuant to Articles 84(2) and 189c of the EC Treaty (C4-0456/97), - having regard to Rule 58 of its Rules of Procedure, - having regard to the report of the Committee on Transport and Tourism (A4- 0369/97), 1. Approves the Commission proposal; 2. Calls on the Council to notify Parliament should it intend to depart from the text approved by Parliament; 3. Calls for the conciliation procedure to be opened should the Council intend to depart from the text approved by Parliament; 4. Asks to be consulted again should the Council intend to make substantial modifications to the Commission proposal; 5. Instructs its President to forward this opinion to the Council and Commission.
