Decision on the common position established by the Council with a view to the adoption of a European Parliament and Council Regulation concerning the creation of a supplementary protection certificate for plant protection products (C4-0578/95 - 94/0285(COD))

The European Parliament,

- having regard to the common position of the Council, C4-0578/95 - 94/0285(COD) ((OJ C 353, 30.12.1995, p. 36.)),

- having regard to its opinion at first reading ((OJ C 166, 3.7.1995, p. 89.)) on the Commission proposal to the European Parliament and the Council, COM(94)0579 ((OJ C 390, 31.12.1994, p. 21.)),

- having regard to the amended proposal by the Commission to the European Parliament and the Council, COM(95)0456 (( OJ C 335, 13.12.1995, p. 15.)),

- having regard to Article 189b(2) of the EC Treaty,

- having regard to Rule 72 of its Rules of Procedure,

- having regard to the recommendation for second reading of the Committee on Legal Affairs and Citizens' Rights (A4-0048/96),

1. Amends the common position as follows;

2. Calls on the Commission to support Parliament's amendments in the opinion it is required to deliver pursuant to Article 189b(2)(d) of the EC Treaty;

3. Calls on the Council to approve all Parliament's amendments, amend its common position accordingly and definitively adopt the act;

4. Instructs its President to forward this decision to the Council and Commission.

(16a) Whereas the detailed rules in recitals 12, 13 and 14 and in Articles 3(2), 4, 8(1)(c) and 17(2) of this Regulation are also valid, mutatis mutandis, for the interpretation in particular of recital 9 and Articles 3, 4, 8(1)(c) and 17 of Council Regulation (EEC) No 1768/92 of 18 June 1992 concerning the creation of a supplementary protection certificate for medicinal products;
