Declare that, by failing to adopt all the laws, regulations and administrative provisions necessary to comply with Council Regulation (EC) No 1030/2002 of 13 June 2002, (1) the Italian Republic has failed to fulfil its obligations under Articles 1 and 9 of the regulation;

Order the Italian Republic to pay the costs.

Pleas in law and main arguments

Article 1 in conjunction with Article 9 of Regulation (EC) No 1030/2002 requires the Member States to take all the measures necessary to issue a uniform format for residence permits for third-country nationals by 14 August 2003.
